As Tonker says, it is a pyrrhic victory to obtain a Judgment against a man of straw, and irrespective of the timeline between Claimant receiving compensation and potential attempts to recover monies from them, you can be certain the bulk of it will have evaporated.

The greater deterrent is the Courts having the balls to make more findings such as this

What is needed is I think what they do in Germany. Claims like whiplash are not covered by car insurance but everyone has their own personal injury cover (not just for driving), so I think if you want to claim for whiplash it's always your own insurance that you're claiming against.
