Surely this is a case of missunderstanding between the roofer and the council workers, as it seemed obvious from the article that was his own personal waste, regardless of the manner of bin bag used. In which case the fine doesn't really have merit. Or, as I said, am I missing a point in the article?

He has a bag, which he has paid for, under the understanding that it is to contain commercial waste.He does not have a licence to carry commercial waste.
Sure, it's got some crisp bags in the top. But what's underneath? You are not telling me that bag is JUST his lunch rubbish from the site that he's been working on, and undoubtedly generating commercial waste while he works...
He's taking the piss, and he got caught. He needs to pay to dispose of his commercial waste properly - and that means getting a skip on-site.

That is not a "commercial waste" bag FFS.
It's a common or garden disposal bag filled with lunch detritus. Considering the guy is a roofer by trade, I would expect him to be nicked if he was carrying a 1 tonne sized sand bag filled with slates / tiles / timber laths / roofing felt offcuts, in which case - yes - I'd expect him to possess a Waste Carriers Licence.
Fining him for carrying a small bag of waste mineral water bottles and some empty bags of dreary baked "crisps" is cheerlessness on an olympic scale.
