A 93-year-old former children's home manager who sexually abused children in his care for decades has been given an absolute discharge and sexual harm prevention order

Malcolm Phillips, who lives in Birmingham, carried out the abuse against four girls and two boys at Skircoat Lodge in Halifax between 1976 and 1994

He was deemed unfit to stand trial and a trial of facts was held on charges of rape, indecent assault and indecency with a child

At Bradford Crown Court, Judge Kirstie Watson said Phillips was a 'master manipulator' who committed 'vile abuse' - all from the BBC's News website.

I'm staggered and livid that we cannot simply throw someone like this in a very deep hole and forget about them.

He's 93 very frail and physically very unwell with multiple serious medical conditions

The judge said imprisonment was not an option, presumably because the prison system cannot deal with his complex needs

We still have a duty of care to him regardless, it's basic humanity

It's not an option for a trial of facts.

Hospital order, supervision order or absolute discharge.

Absolute discharge - "the court has decided not to impose a punishment because the experience of going to court has been punishment enough".

That will be a massive comfort to his victims.

Yeah, like that rapist who was released recently... Oh no!, it turns out it wasn't him that did the crime and he had been falsely imprisoned for 17 years.
Still, if a few innocent people are shot so society can get the bloody vengeance it desires, where's the harm eh?

Here's the problem - if you refuse to admit to a crime you didn't commit, you won't get let out on parole.

Yet some people still want a death penalty.

We have become very soft on rape it would seem. This and other rape cases that have made the news recently show potential perps that there is little chance of being convicted of rape and, even if you are, there's a fair chance you can get away without a custodial sentence.

Make it make sense.

If you read down, you'll see, his co accused Linda Brunning, 67, was jailed for 25 years for indecent assault against one boy and helping Phillips abuse another boy in the 1980s and 1990s.
