Man who fractured cyclist's skull in road rage attack given supervision order
Footage of the incident showing Hedley, of Kirkcaldy, Fife, leaving his vehicle and throwing the man to the ground before leaving the stricken cyclist in the road was widely shared online.

Fiscal Depute Peter Finnon explained that the cyclist had suffered serious injuries – including an acute bleed on the brain, a traumatic brain injury and a fractured skull – and that the medics who attended the scene and treated him described his injuries to be "very much to the potential of danger to Mr Brown's life".
“He was blocking my way so I had to move him.” He subsequently added: “I didn’t leave him for dead. He was kicking off."

“You broke his skull and drove away,” the reporter says, to which Hedley simply replied: “Yeah but that doesn’t matter.”
The defendant's lawyer, Calum Turner, said Hedley had "not intended" to inflict serious injury on the cyclist, and that he had not driven since the incident. It was claimed that Brown had shouted at the and shone a bike light into the car, causing Hedley's partner, who was in the passenger seat, to suffer a "seizure".

Considering it was the partner arguing with the cyclist before the attack, it doesn't seem she had a seizure. How did he escape prison?

You think that's bad ?
I'll raise you a 15 year old boy who stalked a 14 year old girl who wouldn't go out with him
Found out wheee she had a Saturday job
Turned up at her work place and stabbed her 10 times including in her face scarring her for life
He also stabbed the shop owner who Intervened
Judge said he was a bright lad who didn't deserve prison ... supervision order for him too

Incredibly lenient sentencing…. There was a guy die from banging his head after being shoved/pushed recently and that resulted in six years in prison.
Perhaps short spell of a month and a longer curfew (one year sentenced ) would have seemed more realistic to save tax payers money whilst reflecting the severity.

I sometimes wonder if Judges are supervised or checked on their sentencing. Sure on the odd occasion the CPS appeal an unduly lenient sentence, but some of the old duffers are on another planet.I'll raise you a 15 year old boy who stalked a 14 year old girl who wouldn't go out with him

This is Scotland. No CPS. This article might explain some of it:

article said:
A big focus of successive Scottish governments has been to reduce the short-term prison population.
This has been achieved through the long-standing policy of a presumption against sending people to jail for short sentences, with the cut off currently at 12 months.
Recent reports have suggested that they re extending the presumption to 2 years:This has been achieved through the long-standing policy of a presumption against sending people to jail for short sentences, with the cut off currently at 12 months.

Under another suggestion, judges would be encouraged to avoid issuing prison sentences of less than two years, up from the current presumption against sentences of 12 months or less.

Yes absolute joke of a sentence. What gets me is that they want to criminalise ordinary decent men for such "crimes" as sitting in the wrong seat on a train carriage but can't punish scum like this. Deal with the predators don't pretend all men are predators.I'll raise you a 15 year old boy who stalked a 14 year old girl who wouldn't go out with him

Wow that was a bit much having watched the video, he gave zero warnings, no request to move just straight to the rag dolling with his hands around the guys throat, regardless of the rights or wrongs that lead up to the situation, that's not the act of a rational person and also not his first rodeo I'd wager.
I once had a cyclist give me an unbelievable amount of verbal abuse (never heard anything like it in my life) all because I warned him not to filter past the traffic as we were all waiting for horses that were just around the bend, he was about 80 years old and of zero physical threat to anyone but wow did he have a potty mouth, but you're not going to start assaulting the guy are you?

Sure no one deserves to be injured, but FAFO and one day you will meet your Kenneth Noye.
Whilst I sort of agree because why the hell would you get out of your car to argue with anyone - from the video it looks like it escalated from zero to "almost dead" very very quickly.Sure no one deserves to be injured, but FAFO and one day you will meet your Kenneth Noye.
How the hell the guy isn't in prison is simply beyond me.

might just be central Scotland, but I've had countless idiots jump out of vehicles ready for what they think will be a fight because of "something" I've done.. filtering, seems to be the main trigger for these idiots.
Most of them come to their senses after a few steps and see that, as a biker, I have a lot of protective gear on that will hurt them if they hit me, or I hit them..
Sometimes though, you get the odd one swinging...
Scottish people with anger issues, who would have thought it!

If it's happened countless times I would be considering if I could make some adjustments to my own driving to bring those numbers down. Most of them come to their senses after a few steps and see that, as a biker, I have a lot of protective gear on that will hurt them if they hit me, or I hit them..

After 30 years of driving in central Scotland it's happened to me once - a deranged Taxi driver who thought I cut him up. Other than that I can't say I've ever had a problem.

I see. So if you get into a verbal argument with someone and they physically assault you, fracturing your skull and giving you a bleed on the brain, that's just a matter of FAFO, when two idiots meet, etc? Asking for it really.
Or is that just if you're a cyclist?
Two things can be true at the same time.Or is that just if you're a cyclist?
Most of us think the car driver should be spending years inside for what he did, but are also open to the idea that the cyclist was an aggressive idiot who was looking for confrontation and found it. There's a reason most of us don't pick fights with random strangers, we don't want to spend time in prison or hospital.

Of course, not being meek and submissive is exactly the same as picking a fight. Most of us think the car driver should be spending years inside for what he did, but are also open to the idea that the cyclist was an aggressive idiot who was looking for confrontation and found it. I remember when this was all powerfully built company directors.
