'How can the loophole be closed? New legislation — effectively giving the Attorney-General the power of vetoing certain warrants for arrest, such as those against foreign members of state and high-ranking former politicians — seems to be the most likely solution. The idiosyncrasies of the British justice system cannot preclude its international allies from accepting invitations to visit Britain.'
But the attorney-general already has the power to issue a 'Nolle prosequi', against any such case brought.
So why is new legislation required? More here than meets the eye.
