What is the basis of the claim?

Some sort of mis selling?

Sort of. It would appear that the NHS is supposed to pay the fees if the person is in a care home principally as a result of an illness rather than just being old; a lot of NHS authorities have apparently been telling lots of people that they should pay when perhaps they shouldn't.

Spot on, my mum has diagnosed vascular dementia and could not live alone and was alarmed living with us (too noisy, too much going on) so we looked at 6+ care homes and booked her in the one we liked the best / most suitable without thinking anyone but ourselves would pay - its my mum she has some money and it will be used for this.

Her money ran out in 18 months / £70k so we sold her flat now thats running out and we will take over but if she is eligible to reclaim then why not - Im just struggling with £50k to the form filler (I know its more than that but how much more for £50k FFS)

Not sure on this.

I know the in-laws got shafted on this after my partners grandmother fell over and broke her hip. She never really recovered.

They tried to recover the fee's and failed. Having said that they are not the most 'determined' people, and I suspect just gave up at the first hurdle.

Not sure why you could not have a go yourself, and hand over should it get more difficult?

DIY - and get in touch with the Alzheimer's Society, they should have someone local who can help (my Dad helps people in his town claim).

Check the T&Cs of the 'legal cover' provision of any one of your house insurance policies. Many of these include 'up to £50k legal expense cover' - and this cover can be used for many different legal advice needs.

This may enable you to keep 100% of any successful claim AND pay a reputable law firm for their work on the matter.

You are most welcome.

Not many people know what legal expenses cover actually is.

It can be very useful.

I hope you get a good result.

Let me know if you want a good lawyer - I know a few!
