tenant in arrears,what next?
Discussion
We have a tenant in a property who has been a nightmare since he moved in.The rent is £100 per week, council pay us £75 he is supposed to make up the shortfall of £25 per week.So far he has managed to find £50,he now is in appears to the tune of £250,from what i have read in respect of section 8 requirements he must be 8 weeks or more in arrears(he is 10 weeks behind)If the council portion of the rent is up to date is my tenant still classed as being behind for the purposes of serving him with the section 8.
His reasons for non payment are that he doesnt get much dole and cat afford to pay us,yet the back yard is awash with beer cans, various damage has been caused to the property by youths during rowdy parties.
All help and advice would be very welcome.

I have a few places I let. Most of which are decent, modern houses in nice areas - where I've had no problems like this.
However - regretfully, I got involved in a property project in a fairly run-down area up North, investing with another party, that went a bit wrong, and then the recession hit, and we're stuck with it, in negative equity.
So all we can and have done, is let it to tenants.
It's a huge property, and at first, we let it to two big families, one after the other - both DSS with hundreds of kids.
They both wrecked the place, and we received nothing more than the first month's rent.
We managed to get them out fairly quickly after default - as you say, we served those notices on them. Despite the fact that a bad tenant who knows what they're doing and the housing law would probably be able to string out what basically becomes 'squatting' through the courts - we found that once we'd served legal notices, they looked sharp and buggered off.
We also visited them in person to serve notice (no mean feat as the place is 350 miles away) and you also have to be careful visiting, it can sometimes be construed as 'harrassment' if it ends up in court. We got around that by sending recorded delivery letters in advance, informing them of our intention to visit.
Amazingly, on both occasions, they were in the house and answered the door - and let us in.
Once we'd entered, looking serious, and serving legal notices of eviction - as I said, vacancy was pretty swift.
PM me if you need any more help - and good luck!

so, he is 10 weeks in arrears? You have to use the whole rent as acalulation rather then what is in arrears by as the weekly calc?
why dont you revise the tennancy, send it to the council for the allowance he is allowed, and then you will get it direct, every 4 weeks. I have recently done this to 70%+ of my properties and it has solved quite afew issues.

So,am I now correct in thinking that he needs to fall £800 in rent arrears?(based on his rent being £100 per week of which he pays £25 the council pay the £75)
Local council are paying me direct as from the 1st sept.
As a further development,I called to the property today and bumped into the local police who are more than keen to speak to my tenant in respect of anti social behaviour problems(4am parties, fighting and intimidating local residents).Hopefully we can get him out soon........................

I'm a first time landlord so have little of use to you from that point of view but I'm also a police officer and we've evicted many people with the local council anti social behaviour team. It's surprisingly quick if they're causing a problem to local residents and those residents are council tennants. Owners or private and they couldn't care less, which is ironic. Local council are paying me direct as from the 1st sept.

I'd call the council and assist the police and see if that helps.
