Hi all,

Not sure if there are any legally minded people on here that can advise or if you've been through this yourself?

In a nutshell, having split from my ex-wife and done the whole court order thing which pretty much cleaned me out, I am now taking on our property/mortgage in my sole name. The mortgage company have said I need a solicitor to act as a conveyancer, but I'm reluctant to use the firm I've been dealing with as I don't think they've handled my case at all well.

All I want to do is take her off the mortgage. She is happy with it and so is the mortgage company (as long as I go from Interest Only to Full Repayment) and everything has ben signed and I'm about to return the documents to the mortgage company, so I'm a little confused as to why I need to pay out more cash to a solicitor for conveyancing stuff?

Can anybody advise or point me to a way of doing it that avoids unnecessary cost? Can it be done online at all? I have seen companies that offer this service when buying a house or changing mortgages.

Cheers for your help. Hopefully this will be the end of a very stressful few years... I had to get rid of the TVR because of this and I dont want to lose any more cars to fund legal bills...

Thanks

Jamie (GruFF)

You are ineffect, apply for a brand new mortgage in your own name, your mortgage with the ex will be no more.

As such, normal conveyencing needs to be completed.

As noted, there is no getting away from the fact this work needs to be done.

Given the amount your current firm are likely to have made from the split, ask them for a price for the work which takes this into account.

I see...

Does this mean I'm subject to stampduty again, because this was mentioned in a quote I had from my solicitors.

What is a reasonable amount I would be expected to pay for such work to be done? I'm mortaging £195K.

Cheers

You're not buying the house are you, you merely need to re finance it?

I believe there's no stamp to pay if you were married

Not buying it, just taking on a different type of mortgage for the same house in my sole name.

The main reason for needing conveyencing is to transfer the title to your name (ie removing your ex).

I've got this fun to look forward to.

I'm pretty sure you'll have to pay stamp duty.
