At start of tenancy the landlord has to pay the agent a fee of X%. No problem with that.

In the T&C's it states that if the tenant stays longer than the first year then it's Y% of a years rent, and after this it Z% per year.... I thought the renewal fees were ruled illegal and unenforcable. Is that the case? Or did I dream it?

As a tenant, I told the agency, and in a quiet conversation, the landlord to stick their fees, and I was happy with a statutory period tenancy. The landlord was quite happy with that.

In the OFT-v-Foxtons High Court Judgement, the decision allowed for Foxtons to continue with their renewal commission charges/fees, the same however should only run for no longer than 2 years from the start date of an agreement, the same must be clearly set out in the agreement with the landlord. The only time the 2 years is void, is where a landlord sales the rental property.
