'Without Prejudice' stated on an invoice???
Discussion
We have a flat and have received the management charges from the new management company that has just taken charge.
On the invoice it states: 'The sums above are demanded without prejudice'
Our vague understanding of the legal term 'without prejudice' seems inappropriate on an invoice.
Advice appreciated please

Hey.....thanks
But, if there hasn't been a dispute - to our knowledge - why have they included the term?
Does it suggest then, that the management company are expecting challenges to their invoices and trying to cover their arses?
From my understanding - background is dispute resolution and contract drafting in infrastructure - they'll be using the term there to cover themselves in case they wish to demand more, or the same / different sum for a different item. Essentially, to avoid limiting themselves.
It means - rather, they think it to mean - that you can't then approach them later, after they've changed the demand, citing the contents of the original letter as reasoning for not paying the sums they believe due.

Interesting as we noted that they have not included a budget forecast.

I would have thought that if it's a new management company it's without prejudice to any amounts owed or paid to the old management company. Invoices usually say EAOE to cover this, errors and omissions excepted, at least they did in the days when I practiced
Agree that it's probably trying to cover themselves.I actually used it when I was paying my freeholder for management expenses that they couldn't justify.
OT but i wonder if it works with parking tickets or speeding fines giving the opportunity to pay early to receive the 50% discount but keep options open to go to court to dispute it?
