Hi, wondering what the answer is to the following:

Mother in private nursing home ( paid by council until sale of property )

Council were in process of putting a charge on property ( nett value £40K )

Property sold before charge was established

Now care home and council have hit mum with arrears/debts which encroach into her £23,500 allowance

My question is. . . . Does mum only pay her debts until she becomes below £23,500 or can home/council insist on their full debt ( nett £40k debts are £25K which only leaves mum with £15k )?

If assets are over £23250 you have to pay in full, between £14250 and £23250 you have to pay a proportion of the fees and below £14250 you are not liable, you will need to ask for another review once you get to £14250.

Similar situation with my aunt. Her total assets dropped below the £23250 a couple of months ago. Council were informed, review started but not yet completed. Mum is still paying the bills from aunt's account. Fees are over £3k a month.

When aunt's assets drop to £14250, does mum just stop paying the bills?
If the council is liable for a proportion when assets are between £14250 and £23250, will they issue a refund to my aunt for the amount that she has "overpaid"?

Very interesting, I was just aware of the £23k rule never knew anything about the £14k level, are there anymore trigger points to watch out for? Cheers

You may be able to get some answers from Age UK: https://www.ageuk.org.uk/information-advice/money-... - certainly worth a call. There's an important difference between a nursing home and a care home.

Thanks. I've suggested contacting Age UK to mum. They have an office right near her
