Good afternoon

As part of the deal to purchase a building plot i agreed verbally among other conditions to pay the sellers solicitors fees ...now the seller has changed their mind on one of the other agreed conditions which will adversely impact me financially if we go ahead ....do I still have to pay the sellers fee if either one of us pulls out ?

I'd say it depends what the contract says when you agreed to pay their fees.

Does it say something like I'll pay the sellers fees of £x + VAT upon completion? If so then the seller has changed the terms and you won't be completing

No mention of agreeing to pay in the contract ...just the purchase price

I had to send the fee to my solicitor as an undertaking before their solicitor would do any work

I am looking into purchasing a plot (20 acres) for a post retirement house building. Nice road frontage with county water, sewer, electricity. Going for about $40,000. Looking at the moment in the center to top of Alabama. Between Redstone Arsenal (one of NASA’s locations) and the Merc factory.

If only. 1/5 acre plot near me in an area I like - £350k but too long/narrow to get a decent house on frown

What part of the country is that?


I’d love an acre house slap in the middle (or more) - new normal could make that sort of thing viable...

Re the build what sq m are you wanting to build? 300m2 or more?
Aim for 1/3 if you can - land is simply so valuable so desirable but location needs. To be good

Is it dirt or gold dust? Seriously, there are 1/2 acre plots in the middle of Baton Rouge here that cost that as well tbh. Location location. My plot would be rural.

The answer is it entirely depends on the wording of the undertaking given. Trying to nail down the terms of the undertaking to cover such eventualities can be time consuming and expensive (as it is something neither party really considered in detail when agreeing the deal).

I usually tell my clients in advance that they can assume the money is gone once the undertaking is given.

The other point to be aware of is that it will be your solicitor who decides whether they do have to pay up or not, as it is their undertaking.
