Hi all,

My house sold pre-COVID but the deal fell through post-COVID as a result of the purchaser's mortgage being changing by their lender. I since changed my estate agent (due to the original agent doing half a job and ignoring incoming queries to view my property).

I recently received an email from the original purchasers with a new offer on my property following a new mortgage offer, which I'm strongly considering. Can I sell my property without engaging my new estate agent, or will the offer have to go through them?

The original agent found you the buyer so the commission should go to them - if they hear of the sale and you don't tell them, they will rightly come after the commission from you

I would bet agent 2, if already engaged, will try and claim the commission or a slice of it

Estate Agent A listed the property for close to 42 weeks. The contract with them has been signed off and all fee's paid approx 3 weeks ago.

So even if that's the case I could still be liable for double commission?

You need to read both agency contracts very carefully, because potentially the answer to your question is "yes".

I was in discussions with a private individual when i was putting my house on with an agent - there was a box on the contract that i could put his name into, thereby avoiding paying commission to the agent for a "client" that i was already in discussion with.

I would guess that EA2 will try to get paid but will back down when you refuse.
