Hi

Niche question for the forum

I got divorced and signed a consent order to give my ex-wife and I a clean break, effective from last week

She has now come to me and asked for more money to pay towards HICBC, she was in receipt of child benefit, it got paid into a joint account and now she has to complete a tax return, to effectively pay back the money.

None of that was captured in the consent order, which she drafted and I signed.

Am I within my legal rights to say jog on, or will HMRC be able to pursue me for the charge

We both earned over the threshold to receive any child benefit, i.e. >£60K, but I am the higher earner.

Any views!

If you were both earning over 60k, offer to put her back in the situation she'd have been in had you yourself been earning under 50k?

If you're both above the threshold and she's been claiming it then that's on her to pay back. If you were both claiming / benefitting the money it see right you both pay it back.

The most it can cost you is a grand for a years CB, I'd just pay it and be done with it.

If you ae both over the 60k just split it and pay it back. If only you are over the threshold then you will have to pay it back. It's about £2400 for 3 kids so it's not a massive amount.
