My partner and I are looking to purchase a property together and one things got me stumped, stamp duty,
This new property will replace my existing main residence so that’s easy to work out, the bit that’s confusing things is that my partner owns an apartment in Germany where she’s from and she rents that out. However she has never owned a property in the uk and rents here, so would we need to pay the additional rate when this would be her primary residence?

It’s a UK tax thing, normal SDLT applies only. My wife is also German so have been through this and other DE tax related stuff in the past.

Ahh amazing thanks Jim! Confusing because it says online it doesn’t matter where you own a property! £15k towards the new Porsche then 😂

Be careful: I'm 99% sure what has been said above is incorrect.

My understanding is that if you, or your spouse, own another property anywhere in the world, and you are purchasing a home together, then you must pay the additional home stamp duty surcharge.

Speak to a good property accountant or conveyancing solicitor and they'll be able to confirm.

But quick look shows the additional stamp duty is paid if the purchaser already owns or part owns a property outwith U.K.

Yup second home surcharge applies even if one person owns a home which is outside the uk.

Jim’s response is incorrect unfortunately.
