you can open a charge back for anything, the bank will then decide if it falls within the rules etc. Normally what happens is they suspend that transaction till the next months statement whilst they investigate.
So keep copies of emails / messages etc. Also screen shot of signature etc if possible on the delivery. (if there was one)

I have been successful with a CC claim when eBay decided I was outwith their "money back guarantee" timescales.
In my case I was in receipt of the item, had proof it was not as described and had emails from the (trade) seller telling me to "F Off" as even though they acknowledged the issue they weren't going to do anything as eBay would side with them. YMMV.

Interesting. Genuine question, who did you take to court, ebay or the seller? I've had several deliveries which have arrived here successfully, yet the tracking shows as 'in transit' for ever afterwards. If I was dishonest I could use that to get a free one or a refund.
As for chargeback, the seller can appeal and get it reversed, but if the amount is over £100 it can go to Section 75 for a permanent solution. I had a punch-up with an Aston independent last year; the bank sent me the letter they'd sent to get the chargeback reversed and it was a pack of lies. I dismantled them but by that stage it had to go to S75 and I won.
