Not me but an Aunt in her 90's, just got a letter saying that they need to inspect and/or remove asbestos throughout the property^. It doesn't specifically say she will be liable on a %age basis however I assume that is why they have written to her / all of them.

^perhaps 30 tenants

Can you do anything about this or is it a fait accompli that payment will be due?

Do you mean tenants or leaseholders?

Residential tenants are usually only responsible for paying their rent and cost of any damage they cause. Leaseholders would often be responsible for their proportion of maintenance costs of the building.

What he said, however, once leaseholders front up the cash for the repairs, the rents seem to go up fairly quickly after.

I’ve a flat in a block of 10 and in all likelihood she will have to pay her share.

Frustratingly a lot of cost over the last 3-4 years has been driven by the one owner who lets his flat as a holiday let, as he wants to fully comply with every regulation going. But costs of updating to fire regs has been expensive.

She is aged and only gets the state pension so I'm assuming a tenant vs a leaseholder. She's never "owned" a house or anything afaik.

It would be very unusual for a tenant to be liable for any building fabric repairs. In the majority of cases the building freeholder will organise the work, but the leaseholders (flat owners) would be liable for a % share the cost.

Ok thanks for that. Interesting as to why they've written to her, perhaps just to confirm that asbestos work may happen at some point.

The letter is all very "legal". I might post it up just to see what people think.

If she is simply renting a flat as you suggest I would assume it is simply the landlord having to provide notice that works are to take place, and likely a legal requirement that the landlord has to notify the tenants a period of time before the works can commence

I think if she is liable for any significant costs attributed to this they would have issued a section 20 notice.

I’ve had one recently for replacing the double glazing in the block of our tenanted properties. They have to go through a formal consultation process.

Given its asbestos removal I suspect they have to notify the occupiers, not just the freeholder or leaseholder. The occupiers are the ones who will be be at most risk (or inconvenience) from any work.

A tenant would not usually have any obligation to pay maintenance or repairs unless its part rent part buy or I think some odd retirement/ old folks places.

I would guess it’s simply notification of works.

Yes, but anything to do with asbestos gets very disruptive.
