Hi, First time here seeking some advice.

Had a new garage roof fitted in April, which has started pouring in water.
Builder accepts that they are to blame, but wants me to claim off my buildings insurance, so that he can claim from his public liability insurance.

If i claim on my buildings insurance, who gets the money? sooner not have him back, but need the roof fixing, if i get the cash can i get another builder?

Many thanks for any advice.

Can't see how you can claim on your house insurance unless it was some definable event such as storm damage. Surely you can't claim on your insurance for crap workmanship?

Best first call I'd have thought we be to ask your insurers esp re the follow on question as to whethr you have to use John Wayne again?

What's insurance got to do with it? If it's shoddy workmanship then the builder needs to fix it at his own expense, shirley. Sounds like he wants paying twice to get the job right?

I agree. Ideally you should have had something in writing, but if not he's still liable to put right any defective workmanship for 12 months (or whatever you agreed) The roof isn't fit for purpose, so I would write to him stating that and give him 7 days to put it right at his own expense. If he doesn't then state you will get someone else to fix it at your expense and then you'll have to take him through the small claims court to get your money back. It's not expensive and the first official court letter usually does the trick.
