Morning all,

Me and my brother are currently changing the deeds to the family home from our parents to ours after my dad died last year. Anyone know roughly how long this would take as it seems our solicitor is now taking the piss a bit. Is 6 months too long?

Ours took 6 - 8 weeks to transfer from from original deed holders to the new deed holders.

I think your solicitors are taking the mickey

I'd imagine he has to wait and see if there are any other people going to come forward to stake a claim to it. 6 months sounds about right.

That does sound a ridiculously long time for a property transfer, but it depends on probate if he's died. Why not ring them and ask what the hold up is?

I have bked him several times via email after he has not bothered replying to requests for info. Probate was granted last year through the same solicitors.

if your mother is the sole owner and has given her permissions then there should be no problem i've just done the same thing last month

took about 5weeks

yes The original deed holder would have had to sign some documents consenting to the transfer of the deeds to the new holders, who then in turn have to sign there side of things also consenting to the transfer in to their names.

Like I said, ours took 6 - 8 weeks, and that was with also transfering the mortgage over to new policy holders at the same time.

It only took this long because the dozy mare at the building society kept 'misplacing' all the required documents needed for the transfers.

Who owns the house, ie is your mother still alive and did she inherit it?

There may well be Stamp Duty to pay on the market value of the house even if your mother is gifting the house to you. There may also be an Inheritance Tax issue if she dies within the next 7 years.

Ring you solicitor and ask what the delay is. There may be a genuine reason.

Doesn't mean the lack of response to your emails or information is ok though.
