Plannign permission question - conservatory/extension
Discussion
Hi,
i was wondering if anyone out there was up to date on planning permission issues.
I have a semi detached house.
On the back is a flat roof kitchen extension (within permitted planning permission size).
On the back of this is a large diy conservatory (larger than permitted size!)
The kitchen extension was propably built over 10 years ago.
The conservatory which i think did not have planning permission is over 5 years old.
Now because it is a strange old mixture and not particularly well done i am thinking about knocking down the conservatory and taking the kitchen flat room off ann then making one large room where the kitchen and conservatory are now.
Would i be able to do this on the grounds that everything has been standing for over 5 years, irrespective of whether the conswrvatory originally had planning permission?
I would be able to replace the conservaotry with the kitchen extension and proper roof?
Any help much a ppreciated.
Thanks.

I doubt you would have any problem getting planning permission to put up a new structure where an old one existed. However this would obviously have to be within current guidelines, ie if the conservatory needed planning permission and didn't have it then don't expect the same returns. I had a similar situation on my old house whereby we knocked down a flat roof building on the side of the house and out up a new extension. The new extension was exactly the same size as the old building apart from having a tri-pitched roof. All went through fine.

Can you give us some dimensions of what is there at the moment?
Thanks for the replies. The kitchen extension is about 3 x 5m (this takes up mpst fo the permitted extension allowed for the size of the building).
The conservatory is abotu 5 x 5 m and definately exceeds the maximum permitted.
I want to keep the same size but remake the conservatory in brick and put a normal roof on.

IIRC it has to be up 12 years before you can avoid planning.
I was sure it was 5 years? There was the well known example in the news of the farmer building a castle on his land hidden by lorries and hay. They didn't give it to him in the case mentioned as it was completely and deliberately hidden. Don't know what happened in the end.
So if you talking 3 metres projection from the back of the house by 5 metres wide, then thats fine.
If you are saying you are further projecting another 5 metres from that then you may be in trouble!
If they are side by side you might have a chance.
What depth is your garden?
Have any of your neighbours anything similar???

kitchen 3 deep by 5 meters wide.
Conservatory 5 deep by meters wide directly on back of kitchen.
Garden 50 meters from conservatory to the back.
Next door has exactly what i want.....the same size as my kitchen extention and conservatory...but all in brick with normal roof.
On the grounds that next door has what i woudl be askign for, maybe it might be possible.
I just dont want to go to plannign and find out that i dont know a rule or somethign and am forced to take down the conservatory! (even after 5 years)
