RCD Boards and Meters....

Ive got a property where traditionally the Flat was powered by the shop meter. The shop owner used to come upstairs and empty out the coinbox and that was that.
The shop is now a restaurant and they want the flat to have it's own supply. Fair enough. The utilities company will only put the meter onto a ground floor wall. the RCD however is upstairs though in the upstairs flat, although the front door is downstairs where the meter will be. The utilities lot have also said that the RCD board has to be within 3 meters of the meter.
This got me thinking, i've lived in a few places i.e. apartments where the meters are outside/communal areas (downstairs) but the RCD's are in the apartments way more than 3 metres away from the elec meter.
Does anyone know if the utlity board is right?
