Advice needed please for my new fridge.

Hi guys I need your advice.
I am not great on explaining the way I would like but I will give it a go.
Me and the missus desided to go for a side by side fridge.
We been watching for some time a guy on ebay that buys graded fridges from Whirlpool, with maybe few marks here and there but nothing major. To be fair to him he has great feedback and he's been selling the stuff for many years with lot's of happy buyers. But I an the unluky one.
After we had a bid sesion and won the fridge I knew right from the start that I will collect from his place as he is not very far from me and for us saving the £80.00 delivery charge he wanted.
I emailed seller saying that I would like to collect the fridge from his premises. I said that I have a box trailer to collect it in, and my question to him was if it will be ok if the fridge is placed in the trailer laying on it’s back. The response from him was that will be ok and that he will help me to load it.
Arrived at his premises and I inspected the fridge for any damage as best as I could, but that was not easy as the factory protective film was still on.The fridge was on and cold inside so everything was as was described on the listing. After a brief explanation from the seller how everything works he helped me to load the fridge on my trailer, on its back, resting on a long floor mat and off I go happy chappy.
On arrival home I had help from two mates and unload the fridge from the trailer and placed in kitchen, left it for 24 hours before I plugged it in the mains. There was a hissing noise from the rear of the fridge but I didnt think any more of it. Well 24 hours later after was plugged on the mains the fridge had not cooled .
I emailed seller explaining that the fridge is not getting cold. He kindly arranged for an engineer to call in and have a look. Engineer found that the brazed pipe to compressor had broken off and lost all the gas.
On the engineers report saying that the pipe was’ positioned poorly’ causing it to be touching the metal cover behind the fridge.Is the seller responsible for gave me a wrong advice about loading the fridge on the trailer on it's back.After all he is the one sells and repairs them so he should know better? The compressor is on "floating mounts" to prevent from vibration noises. By laying the fridge on it's back it may cause the compressor on every bump on the road to move up and down with force this may cause the pipe to brake due to been too close on the cover/floor.
The seller offered send me a replacement part but I have to pay postage and installation.
Installation for part will cost up to £400 as will need to be re gas too. I suggested I bring item to him for mending he has not responded. After that he was not interested anymore.
The seller saying that the item is damaged in transit......yep I know that now, but if I know that the pipe is there I woulnd put it on it's back.
What you guys thing I should do? I have opened a case with ebay but I had no responce from him. He's not responding to my emails and he has gone all legal with me. The last time I managed to speak to him he said that his Ebay manager told him that he's done everything right.......but thats before I opened a case with ebay, so he told the manager the story the way he wanted.
I just want the fridge repaired by him. I am not askying him for a refund or a new fridge. Just for him to repair it.
What you guys think?

Honestly? I think you should chalk it up to a lesson learned that you shouldn't be resting big heavy fridges on their backs where the heat exchanger and pipework live, I certainly don't see how it can be in any way the fault of the person who sold it to you that you were uninformed. Sorry.
+1 unfortunately looking at this from his point of view, you collected a fully working fridge from him rather than pay delivery and now it's not working.....
I think you might struggle with this to be honest - may be worth asking him for a contribution towards it but it sounds as though those bridges have been burnt.

I think he's done more than than most would, by paying for an engineer to come out and paying for a replacement part (£400 for a fix and regas seems a lot though).
I'm hardly a fridge expert but to load it face-up on a trailer so that the very heavy fridge can bounce up and down on the very fragile pipes at the back seems a recipe for disaster, sorry!

That looks like a clean break, like it snapped, rather than was bouncing around and flexing.
As you say you heard a hissing sound when you went to turn it on, I'd presume that is when it broke, so it doens't sound like it broke in transit or else you would have had oil leaking out of it too and the gas would have been all gone before you went to turn it on.
What is the make and full model number of the compressor, I can see how much it should cost.

It sounds like the eBay seller has been reasonable, as others have already said. Sending an engineer and offering to give you a replacement part is more than generous, perhaps it's not too late to take him up on it?
I'd guess that needs some brazing and a re-gas, I imagine there are lots of companies out there that can do it without any spare parts required.

I have attached a picture of the label is on the compressor. If you can get us a price that will be great.
I spoke to another company this morning and they gave me a more realistic price of £240.00 + vat to renew the compressor and regas ( labour only that is ) much better.

its snapped clean off at the compressor case, no way to repair that one. Pipe is quite thick at that point and I have never seen such a break. The hissing sound may have been just the compressor sucking air rather than a gas leak so it could still have happend on the trailer, the gas all having gone the instant it broke. IME these things should only be transported upright, the cabinets can flex and the doors not fitting correctly afterwards are just 2 reasons not to lay them down, never mind system faults like this.I'd guess that needs some brazing and a re-gas, I imagine there are lots of companies out there that can do it without any spare parts required.
