Long story short and deliberately vague (buyer could be on PH).

I sold some tyres on Ebay for around £800.

Buyer gets them and says they're not as described - opens dispute.

They are exactly as described, but won't do what he wants as he's looking for ice and snow and these are mud and snow.

Ebay decides that I should take them back.

I ask them to explain why I should take them back when they are as described.

They issue him with a full refund before I've agreed to take them back.

They then realise that they can't take the £800 from my Ebay fees direct debit account as I've already cancelled this.

It ain't in my Paypal account either as I've emptied this.

What can they do?

Will I get a ccj if I don't give them £800?

Will my credit rating be affected?

I still haven't agreed to take them back, nor has the buyer contacted me since refund to ask if I want them back. I expect he will try to force me to pay the £80 post as well.

Not impressed with their bully boy tactics here.

I can sympathise, but you're bound by the terms you agreed to:

That can include recovering the money from you that they've already refunded.

Related to this, I sold something on ebay via Parcel2Go which has since been lost by TNT, the item was sold 48 days ago and reading through the T&C's it says a case must be raised within 45 days by the buyer. We're now on day 49. Does this mean the buyer cannot raise a case?

Best thing you can do is just take them back and re-advertise. It’s not worth the hassle.

Honestly can the collective PH might not generate a new auction site that requires an intelligence test prior to being able to purchase or sell? The number of mongs on eBay astounds me! I shut my shop after 3 months because of the stupid star system! People don’t realise they are f**king with sellers livelihoods! once you get to powerseller status you get a discount which is much needed given the extortionate sellers fees! I wouldn’t care, but I sent them within the allotted time frame! One the royal mail cocked up on, even sent me £20 to say sorry...yet my fault!

Off to sit down now...Still annoyed!

Correct, the buyer now has no case and no matter who he talks to at PayPal they will say "You should have opened a case immediately as soon as you had concerns, we can't do anything now". I hope you claimed from the courier!

I to am starting to get fed up on ebay. I listed several items with a estimated dispatch time of 10-14 working days.

The items finished on Thursday and I had messages on the Saturday from someone saying they had not received their item and they wanted it for the weekend. They quoted my advert saying the item would be posted 1st class and thought they should have it by now.

I suggested they read the 10-14 working days part and if they wanted an item sooner they could have bought one brand new - the case is now being looked at by ebayrolleyes

You are probably right, but I'd be £70 down on this from final value fees and Paypal fees even without return post costs.

They have only asked me to refund the sale price, not his courier pick up costs so far.

If I take it on the chin I'm going to have to consider not selling on Ebay again.

Similar thing happened to me and they took the money from my paypal account even though I'd closed the account. They then set a debt recovery firm after me. This was for appx £45.

They didn't get their money back.

ebay and paypal too often side with the buyers...that and the prices they charge make it a game not worth playing anymore.

If eBay refund, you will not have to pay the final fees and also the PayPal fees.... So just kick it out as a bad experience...and re-advertise.

OK - that's interesting.

Ebsy hasn't said that to me yet - think they are still sulking about me shutting down their 'reimbursement' options.

Also don't know if the buyer will send them back and pay post, as he's already got his money back.

He may just sell them down the pub for cash.

He wont have "his" money as yet...you have to get in touch and get them sent back. Once you have confirmed receipt then they will transfer the monies...at the moment I imagine the monies are in a holding pot.

The best thing you can do is communicate...this isnt going to go away, and will get awkward. Just suck in...know you are the better person and spit on the money when you put it back in! Any luck the next set of tyres might puncture when he is stuck in the middle of nowhere and he will freeze to death in his car waiting for the AA..lol

I sympathise with the seller, eBay used to be very good but now they have you bent over a barrel.

If it were me I'd stick it out through principle, the item was exactly as described, so I don't see how the buyer has a case

Selling on Amazon is worse..........I sold a fair bit of stuff (CD's & books). I only got one feedback from all the buyers and that was negative (goods arrived late - thanks Royal Mail rolleyes )

According to Amazon I therefore have 100% negative feedback so am now barred from selling via them!

eBay went downhill big style when they took over PayPal. Now you're stuffed as you can't not accept PayPal, and therefore you're stuck with their retarded returns/dispute systems.

Because there are no appeals process! eBay is judge and jury and you have sod all influence on this matter. They are very quick to head to the legal route which will have far deeper ramifications than a small amount of pride!

As said...suck it in and know you are the better man.

To be honest, seeing the 'dispatch in 10-14 days' line, I wouldn't have given it a second look. I don't understand why (unless there is exceptional circumstances) it should take someone that long to send an item. I reckon the time given for payment should reflect the time for dispatch. People might not be so tardy in getting something off in the post if they had to wait two weeks for payment smile
