A while ago I ordered an item via ebay, it was posted recorded delivery, but I never received it, so started a claim.

The seller has provided tracking info, and this is what it shows on the delivery date.

1138, delivered, no signature.

1140, delivery made notification.

1141 no answer, not available for collection.

1143, delivery attempted notification.

1410, delivered, no signature.

I have no idea what is going on with all those notifications, the seller has stopped communication with me, and I have to wait 4 days until I can escalate to ebay, but get the feeling I will get my pants pulled down, and they will say it was delivered.

How can I prove something wasn't delivered. And would the lack of signature, and saying it was delivered twice go for, or against me?

I would have thought the sender would put a claim into the courier to delivering it without signature. Assuming he used such a service where it had to be signed for. If not his problem, IMHO.

They used Royal Mail 48 tracked.

Take this as its meant.
If they DID use Royal mail 48 tracked that is NOT the same as Royal mail signed for
It shouldnt matter if you paid extra for signed for OR if it was included in the price
IF it wasn't sent Royal mail signed for then they haven't complied with their listing description

To be fair I think they may have described it as RM signed but sent it tracked as its cheaper. Tracked is a weird one as I have physically seen our wonderful lovely postman get out the van with stuff and beep it at the door as its handed over. On other occasions I have seen him walking to the house with no beep action and handing it over. Either way when I checked the RM tracked number the seller gave me its been marked as delivered. I suspect some posties "beep" it before they get to the house.
Are you in a flat by chance ?

How come they delivered it twice? Looks very dodge to me, however, to be fair to the seller, if I had a Post Office tracking that said delivered I too would be suspicious of a buyer claiming for repayment, wouldn't you?

I have been very lucky selling and buying on Ebay very few issues and these have been amicably resolved. Good luck OP.

I suspect its been delivered to an incorrect address. My explanations are crap but here goes.
You live at no 1 Deep Purple Avenue

Postman also delivers to no 1 Whitesnake Grove he/ someone else has incorrectly placed YOUR parcel. with other letters for Whitesnake Grove Postman beeps the mail with his beeper and walks up the path to 1 Whitesnake Grove. At the door he realises that its not for 1 Whitesnake Grove and puts it back in his bag
Later on he and the van go back to the sorting office and beep it again

Does the reference number have a lot of digits and end in the letters GB ?

Yes if I was the seller I would be suspicious, but I would also be contacting Royal Mail, and asking for answers RE the tracking.
MKnight702 is that the signature ?

Sorry trying to quote two of you. I failed.

The tracking ends GB as you said.

Yes as a seller I would be suspicious, but I would also be chasing up Royal Mail, and asking what was going on with all those notifications.

Just to round this off for now, I lost the case, so no item, and lost my money.

Not sure what my next step is yet.

Some people might say they have now received the item. But not happy with it and would like to return.

Those people might then post an empty envelope special delivery. And then use that to prove delivery

And get their money back

Obviously I'm not suggesting you do this.

1. Complaint to Royal Mail - hard to find the complaint form and will take you around 10 -15 minutes to complete. Royal Mail wont rush you will get an acknowledgement pretty quickly but you will need to start chasing them after a month.
2. Inform seller that you know how it may look but you genuinely did not receive the item and are pursuing the matter with Royal mail be pleasant with him explain you understand his POV but that you feel unhappy that you have not received the item and are pursuing it with Royal mail - this way there is a paper trail so to speak.

I have to say I've always had a good experience with eBay. Bought and sold things on there including quite a few watches.

I've had very little not arrive and always seem to get this resolved easily.

However this recent one might help you. I bought two pairs of French Connection trousers from USA to be sent to me here in Indonesia.

They didn't arrive - had comms with seller - agreed to wait a few weeks longer. Still didn't arrive and seller stopped responding to my emails.

I raise a case with eBay and also sent seller more emails via the eBay message centre (nice ones, as eBay obviously have access to your messaging).

In the end I got my money back because even though the dispute was outside the 60 days limit the seller had used USPS which only tracks to the point of departure in the USA. It was therefore not a delivery with full tracking as promised in the listing. That's the bit that might help you?

Also during my calls with eBay they referenced that I had been polite and done my best to resolve the situation.

Funnily enough once the money had been refunded, c$80, the seller did respond back saying he was going to fight it - he sent them - I'm a thief etc etc...

I have calmly explained that a) I'm fortunate that I don't need to steal trousers in a complicated ebay scam B) if he'd communicated with me instead of hoping the issue would go away then eBay might well have found in his favour c) I find his racist comments quite amusing but eBay might not..?

He really is in a rage - the poor chap!
