Hi all,

I recently clicked 'make an offer' on an item that is around £6500. However, between the time of making the offer on the item, and the seller actually getting back to me and accepting my offer (hours), I studied the photos of the item much more carefully on my laptop and realised the item was in very poor condition, but this was only noticeable once you zoomed right in on the photos and had a good look.

I messaged and told the seller I didn't wish to proceed with the purchase and explained my reasons that upon close inspection it looked in poor condition which was not mentioned in the advert. He said he was quite annoyed as he had now lost all his watchers on the item and would have to resist it.

I apologised and asked him to cancel my purchase. He did not reply and is now ignoring my messages. I note he has resisted the item on a new advert.

I now keep getting messages from Ebay warning me to complete the purchase. I tried to raise a dispute or cancel the order via Ebay options, but it would appear they only options I am offered is 'pay now' and "It's too late to cancel the purchase - ask the seller"

I have used Ebay/paypal for 15 years, but never really come across this issue before, so I don't know what to do.

My biggest worry is that Ebay or PayPal will somehow take the £6000 that I allegedly owe? I don't even know is this is possible? I know they take Ebay fees and suchlike automatically from my debit card without me having to do anything.

Any suggestions?

They can't make you pay, though if you make a habit of "buying" and not paying, they may eventually suspend your account. Buyer is king on eBay though, so it will probably never come to that.

You'll be ok. The seller will eventually raise a No paying bidder claim against you to get his final selling fee back (circa £600). This will put a mark on your account but to no ill affect unless you do the same another 2 times within a short time frame.

I imagine deep down in the terms the seller could go through the legal means to seek settlement of the contract or loses caused by you backing out but in reality.....it won't happen. They can't even leave you negative feedback.

I don't make a habit of it. I think it's the first time I have ever done it in all the time I have used Ebay!

£6000 will get taken from your account and a 12 month suspended sentence for timewasting.

Why do I get the distinct impression this isn't a serious answer?...

I think it's very serious. It happened to me as well. And they made me wear slippers to work.

Nothing will happen
the seller will at some time have to cancel the purchase as otherwise he will have racked up £650 of e bay fees. they will appear now on his e bay account if he looks but certainly they will appear at the end of the month on his October statement which he will receive around 2 weeks from now. He will at that point certainly cancel the transaction

As others have said nothing will happen to you. The seller CAN leave you feedback however he can only leave you positive feedback he cannot leave positive feedback with negative comments - if he does you can have it removed. He can report you to e bay and he will receive a very consoling reply from e bay but unless you make a habit of it then nothing will happen to you

As a seller myself I can see why the buyer would be pissed his point about losing watchers is a very valid one.

I bought a motorcycle off eBay, won the auction, but for reasons I won’t go into I cancelled the purchase. It asks why, and I chose the “this item is not for sale any more” option. Simple.

I’m sure you can explore your options a bit more, mooch around the page, and find an answer, as I know PayPal and EBay desperately try to steer you through their system so they get commission.

I tried to contact the seller in the case above, but almost everything I clicked pointed me to “Pay Now With PayPal”.

But seriously, offering 6500 notes and THEN looking closely at the pics.... really???

Yes it was actually.

I take the point above about the amount of money involved and not looking at photos correctly, but it was described as being condition 8.5 out of 10 and in 'good condition'.

I don't doubt some of the blame lies with me, clearly my idea of 8.5/10 and a watch dealers idea of the same score is quite different.

It really was only when I really zoomed into the photos and saw the scratches that I decided it wasn't for me.

Unfortunately though his listing did have pictures and you could have looked clearly at them before clicking buy. I would think he may add you his e bay blocked bidder list. Some sellers also subscribe to the various but ineffective block this bidder lists that circulate and can be found on the web. as a side point its a good job you have e mailed him as recently e bay have introduced policies that mean a seller can still be deducted the fees even if the sale is cancelled. It's part of revamped terms and conditions and its to do with e bay protecting its fee income. its aimed at the people who list and sell on cash on collection then cancel the order thereby avoiding the fees. A lot of people are not aware of the new terms but hey are kicking in over the next few weeks. At least your e mail communication can be used by him as evidence of cancellation.
