Yet another eBay gripe.
Discussion
Hello,
I just received a message from eBay, after waiting over a week for a seller to send the item I 'won'. Two gee-up messages had brought no response and the seller has cancelled on the grounds that the item is damaged/out of stock. He refunded too.
He's a member of seven months' standing who clearly decided my 'winning' bid wasn't enough, probablyafter returning from a half term holiday. He's a private seller, so 'out of stock' is irrelevant and as far as 'damaged' is concerned, I don't believe it for a nanosecond.
What about the eBay user agreement and binding contract? A chat proved it to be utterly toothless. Apparently, the seller will get a 'defect' on his account. Too late, there already is one - him.
Why should I, an ebay member with 12 years' experience, 100% positive feedback and no customer letdowns get a broken contract of sale and no help? Scandalous

You cant do anything really. You can leave him poor feedback. You could neg or neutral him but personally I only neg people if they really take the piss. Maybe neutral with a seller cancelled as out of stock after low bid
People will get the message.
Thanks techidave,People will get the message.
Negged already - and on the community forum! As for the alleged damage I think I'll message him for pics. After all, his listing pics were good.
And out of stock? A private seller with one item listed? Don't think so.
To be blunt I think you need to let it go now.
If you had negged me and were then demanding to see proof of etc I might be inclined to start getting narked
Its just e bay and whats the rest of his feedback like as a seller.
Oh and you can always see if someone is a t
t by looking at the feedback they leave.
Give you an example, guy buys item off me then asks iot be sent asap - and if its in received quickly he will give me good feedback.
Only problem is guys bought it on global shipping programme and hes in Australia
I'm suspicious so I look at the feedback he has received and left. hes left some neutrals with comments like "took long time to arrive" waited ages etc. I think sod that so I message him saying I have no control over ebays global shipping timescale and unless he replies acknowledging that I will cancel the order. I give him 2 days then I cancel and refund.
I risk him leaving bad feedback but at least ive not exposed myself to losing the item or a claim for loss
Ive blocked him too

Seriously wondering what the problem is. You've got your money back without any issue and are just manufacturing a scenario about the reason for the no sale.
He is just pissed off thinks the rip was taken. Basically seller lists something and doesn't get price he hoped so decided to fabricate reason to not sell. techiedave said:

Straight up refused to send the item after he realised how much shipping would be from NI and not the £3 that was on the listing
Paying it would have mean't it'd be cheaper to buy a brand new example. Then told me to open a paypal case!
Negative feedback & reported to ebay customer support who gave him a warning for "non-performance".
Got my money back after 2 weeks.

What a moron he would have been better refunding you himself. I had one guy who sold something that was faulty as used. He knew it was faulty but tried to get round it by describing it as used then hiding away that he hadn't tested it yet saying how well it worked ???Straight up refused to send the item after he realised how much shipping would be from NI and not the £3 that was on the listing

So I contacted him by using the contact thing then when no reply simply opened the case he whinged at that then decided to refund. Great but he refunded on paypal and it was by e cheque which takes 10 days. He wasn't too happy when I gave him a negative. This year I gave 2 and that's on over 480 purchases.
Re- legally binding contracts. There is a legally binding contract between seller and buyer however they only enforce it when a buyer refuses to pay the seller as they can't force the seller to post the item.
The only way to force the seller to send you the item is to take it to court.

I'm in agreement with this, sadly ebay aren't, I bought an item, 3 weeks later seller says only one of the pair are in the deal (listing stated as per picture) , told them to rethink, then told cant find them, and got a refund. I leave negative feedback, then receive a crappy email from the seller, later checking the feedback its been removed by ebay! Nothing I said in my feedback was untrue.People will get the message.
Ebay protection, erm, not really
Agreed. We get all that about eBay favouring the buyer, then about their protecting the seller, etc., etc. Plus, the seller assumes all responsibility, blah, blah. Then he breaks the contract in direct contradiction of the rules. Protection my arse.
It was change out of £50 for a rifle 'scope. I 'won', paid very fast, job done. So who's the honest broker here and who should suffer?
I reckon his account should be shut down.
