This came up as a topic over a few beers, we didnt know the answer.

A bloke was given £50 in premium bonds by his mother 40 years ago.

20 years ago he got married which turned out to be not the perfect bliss he could have hoped for.

He has won big on the premium bonds and is not that keen to share the winnings, he takes the view that when his wife sold inherited jewellery that she did not share the proceeds when they were sold.

He knows that if he shares the winnings that she will spend it immediately or give it to her daughter and then come back for more of his share. Divorce is not on the cards

Any aspiring lawyers out there? Is he obliged to hand over half the money when the original bond was a gift to him.

The amount involved is £100,000

I believe that sky fairy prose is not specifically stated in law.

There are other ways that he may lose more than 50% if it comes to divorce.

IANAL, but have brutal experience.

Perfectly possible to exclusively own an asset when married.
It will be considered part of the joint pot when she divorces him for trying to keep it to himself though.

"endow" doesn't mean "give you now"

It means "its yours when I croak"

Of course, some on here might consider it to be the best £50,000 he ever spends..

From what you have said this is clearly a non-marital asset.

If divorce is not on the cards through I don't understand why he doesn't do something useful with it though, such as pay down the mortgage or invest it for retirement (or blow it whatever he feels like.

It's not as though he has to hand her half to go shopping with.

Advice appreciated, thanks all. I suspect that he will pass on half the money rather than put up with the grief.

Reinvest and not tell her?

If her diligence on bank accounts is low; get an expensive hobby, like cycling and tell her that everything costs 99quid from Halfords?

Sounds like one of my friends who came into a pretty hefty 6figure sum when his dad passed away and bought a few properties which his Mrs knows nothing about and he rents out and the proceeds are squirreled away with one of the disrupter online only banks (Monzo I believe)

But why, given you have already said he is not keen on this and she will blow it?

It makes no sense whatsoever (particularly given she did not share her inheritance windfall with him).

There is a big difference between marital assets and non-marital assets (though in divorce the Judge can exercise discretion here - but this is not divorce).

dont see why it wont tbh as there are literally a couple of people know about it, none of whom have any allegiance to his Mrs - hoardly like its never happened before

You have to declare your holdings when it's time to settle the bill for your relationship. It's a little hard to disguise multiiple houses.

Simple, practical, answer is trap shut.

Put money in totally unknown to her account and spend.

When/if asked how paying - a little common sense should delay this happening until at least some fun has been had - explain that just as she did with her inheritance it's yours not 'ours' money and she can vicariously enjoy if she wishes, or GTFO in which case at least he will have a bit of fun, and whatever 50% of what's left is worth after the divorce.

Simple answer though is use pay for the divorce they so obviously need if people are even considering trying to hide £100k from the wife/husband.

Hide it in an account under the name of someone you really trust?

i.e mother, father, brother?

You'd need to consider the pitfalls of doing this however (what if something happened to them, etc)

Buy a nice car/s & say they were inherited from some long lost relative & that they are not to be sold.

Keep a little cash hidden to pay the running costs which are obviously hidden from the OH like most of us do anyway hehe

IIRC, in the scenario where a married person wins the National Lottery, then decides to up and leave with the winnings and the bimbo from down the street, their spouse has no right to any of the winnings in their divorce proceedings.
