I sold a brand new phone on ebay.

Bloke's received it and is saying it's not brand new and he's not happy as it's not advertised as described.

It is brand new. Box, packaging, never used/charged/SIM inserted... brand new.

I reckon this guy has received it, had a play, decided this model isn't for him and doesn't want it any more. As PayPal is a bit crappy at resolving disputes I've said I'll refund him if he sends it back but he keeps saying "I'm not happy".

I smell a rat. What's he going to do? Complain to PayPal, PayPal return his money and he keeps the phone? I take it PayPal couldn't give a hoot if it is brand new / as described as they have no way of telling?

Another "I've been fooked by ebay" thread.

This is reason number one why I've got a dozen phones sitting in a box at home. I'd rather let them collect dust than get stung by a scummer trying to get himself a free phone courtesy of paypal and ebay (and yours truly).

Sounds like that is what he is trying to do, try and get the money out of paypal before he opens a dispute and it gets blocked in there, otherwise the c**ts favour the buyer automatically and just take the money. Keep fighting your corner, it is as described, he is a liar and a scammer, state this on any disputes, do you have proof of postage etc?

Email him through Ebay, and tell him that you have photos of the box, the packaging etc and that you have kept a record of the imei (or whatever it is) number and the number of the sim card etc. If he really wants to send it back then you will hapilly refund him the original cost of the phone (only the phone and not postage) when you have examined the phone and checked that a) he hasn't broken it, and b) its the original phone that you sent him.

He will need to send it back via a trackable method (but you don't need to tell him that).

It sounds like he is after you doing a partial refund, don't bother with that.

Keep all emails going through Ebay, and if he does take it to a dispute, then only respond through there. Telling him about the photos, records of the numbers etc may just be enough to put him off if he is a chancer.

Also, if he does take it to Paypal, they will tell him to send it back, so be wary of any recorded delivery post that you get, sometimes they are known for sending you a letter, but they have a tracking number to give to paypal to 'prove' they sent it back.

Something similar happened to me once when I sold a phone on ebay. The guy claimed it didn't work when it feckin did. I offered him a refund and asked him to send the phone back. He wrote a few unhappy emails to me then put a dispute in to Paypal who took the money off me and gave it back to him. I also never saw the phone again. When I complained to Paypal I was told to get lost, then given the run around and eventually gave up as I was new to 'ebaying' and found the whole thing confusing.

I've never sold anything on ebay ever since, and only buy from there as an absolute last resort.

As said above, get the funds out of your Paypal account as soon as.

Maybe he already had that model of phone, but broke it. Now he has bought this one off you, says its not as it was described. He wants a refund, but he sends you back the duff phone while keeping the new one and the money you've refunded to him. You're then out of pocket and left with a duff phone.

Sounds like you're about to get shafted.

He's probably going to send you a knackered old phone back, while he keeps your new one. Paypal will then refund his money.

+1 sounds like this to me, a bit like the fake Rolex scam.

If its not been opened when sent to the scammer and the pikey has all the other stuff that is on the phone recorded (serial numbers, etc) then ask for it back in the same condition that it was sent in (obviously you will have pictures to prove the condition), then raise a dispute and a theft charge against him and a nice solicitors letter.

That should st him up...

OH and stop using PAYPAL.... you would think after the hundred or so people on here saying what paypal have done to them that some people may actually read the threads.

This scam is turning into the nigerian scam, were everyone says they wont get caught out as they aint that stupid and low and behold look how many intelligent PHers are...

Turn up with some "friends" explain your sorry there is an issue with his purchase but your here to resolve it, if he can demonstrate the problem you'll happily take the phone back with you and refund him.

Then look menacing.

Ta, but I don't have any pictures of it.. it was brand new, so I went with the stock pictures on ebay.

It's not that bad as in this little ebay spree (not done it for years) I've shifted £600 of "stuff" that's been collecting dust and is unwanted. Not sure there's much else to do with it really?

However, I do have another chap who's received a camera today and claims it doesn't work. I guess it's broken in transit (or he's dropped it), but this guy can construct a sentence, is polite and courteous so I think that's a bit more "sh*t happens" rather he's trying to pull one.
