If you bought a camera for a very good price at a large high street retailer, and after a while it develops a fault...
You take it back to them, they hold it for 4 weeks and finally tell you "the cost of the repair is higher than the value of the camera - so we're giving you a refund".

A refund of the discounted price which you paid is not nearly enough to replace the camera with an equivalent.

So you're left with a bunch of camera accessories, and not enough money for a camera.

Is that fair? Would you accept that? Or should they be giving you current market value for an equivalent model (or a replacement of an equivalent model)

How long is a while?

I would just expect them to replace it.

No.

I would like them to replace it with an equivalent model (the one I bought is no longer sold). Even a pre-owned/refurbished/manager's special/whatever.

ETA: Actually I'd like them to repair it. But they flat out refuse.

They should replace the camera or give you your money back...they won't give you more money than you paid!

It's actually a tricky one. A breach of contract should put you in the position as if the breach had not occurred. On one view, that means you should get a working camera equivalent to the one which you had.

On the other hand, why are they not simply giving you another camera of the same model?

It's now been over 5 weeks since I've seen my camera. It took me a few hours from being told "we're not fixing it" to asking them to give it back.

Just wish I hadn't bought the accessories for this camera. Or at least if they'd told me sooner that they're not fixing/replacing it, I would have had time to return them.

I did ask consumer direct what they thought about the situation - they say I am entitled to "consequential loss" for the accessories. Although TBH I'm not sure they're right.


I actually have another camera bought from the same shop earlier this year at full price (well, with an online discount). I paid an extra £50 for extended warranty. Really regret it now. Prices have gone up at least £100 since then. So if this camera broke too, I now know the warranty wouldn't cover it at current market value frown

Yes, but... how long did you own the original camera before it developed its fault?
