Whilst at B&Q we noted a really nice, discounted, shower/bath mixer tap then went home, looked on Ebay, and bought the same model (so I thought) and saved £30....result. Not.

This weekend I replaced the bath and went to fit our shiny new mixer tap, with autuomatic temperature control and everything, only to find I'd actually bought the one without the bath tap outlet, it's just the shower.....feck and double feck!

I dropped a clanger and didn't take enough notice but I was wondering where I stand with returning the unit. Obviously it's still brand new only issue being one of the polythene bags holding a pipe fitting was opened. I opened that before realising it was not the right unit! It was purchased from an Ebay shop so can I send it back under the distance selling regs?

I do feel bad asking for a refund but I'm not in a position to take it on the chin at the minute.

You can only ask. I'd offer to pay listing fees and postage though. Just to be nice.

No. Auction distant selling regs dont apply.
No no right to a refund if goods are not faulty.
No - you chose the wrong item, its Your fault.

put it up on ebay , new unused etc

someone else will probably pay similar money

Email the seller and offer to cover their costs if you return the item to them. Ebays rules are so weighted in favour of the buyer that he will be shocked by someone offering to cover his costs, rather than saying it didn't arrive/was broken/ described wrongly and scamming him, that he will probably send you his daughters chastity belt keys.

I would have no problem offering a very reasonable re-stocking fee. Will have to give it a go. Last resort will be re-listing myself.

I thought the DSR's were for this very purpose. i.e. if in a physical shop I would have seen the tap unit was not the correct one. On ebay with the little picture it's easy enough to get mixed up, as I found out! Bloody DIY, I'm aching all over from a weekends hard labor too and had to put my old taps back on! Arrse.

It was a buy it now listing from an Ebay shop, do DSR's still not apply?

DSR used to not apply to online auctions sites. I think some of the rules have altered since online auctions became so big, but most of the rules seem to be made up by ebay and paypal.

Someone with an ebay shop will be used to this kind of problem and may already have a returns policy in his listings.

Email the seller and ask if you can return it, they may be willing. You would have to pay to ship it back though.

If he says no, just sell it yourself. Don't start quoting distance selling regs, it was your mistake after all....

Have a chat with the guy, maybe he sells the one you want and will upgrade it for the difference?
May people really want to build their Ebay businesses and will be quite accomodating of customers who make mistakes. Private purchases are a different matter IMHO.

If an item was purchased with a buy it now price, and not won at the end of an auction, the DSR's apply. The decent thing to do would be to explain and ask to send it back at your cost, and the seller should not charge you anything if it is in A1 condition. However they maybe annoyed if the box is ripped etc even though the item is as new, and may require a re-stocking fee.

The regulations actually state the buyer can request to return the item with 7 days of receipt, and the seller collect or re-reimburse for return postage costs.

Yep, just looked it up.

I'm all up for making sure the seller isn't out of pocket.

I know what it like as I sell quite a bit of stuff myself through Ebay. Currently got a fair wedge witheld via Paypal by some Italian muppet contesting the description of an item I've sold. I appreciate the need to protect the consumer etc but the process isn't exactly a quick one! That money is needed elswhere!

Dave, are you sure it wasn't advertised on eBay as a Bath/Shower mixer? You may have been sent the wrong thing.

The reason I mention it is that I have just won a Hansgrohe bath/shower mixer on eBay which is identical to the one you posted last week - following your suggestion of eBay rather than B&Q - and it's definitely got the bath filler bit (at least in the pics); be interesting to see what arrives!

I utterly cocked it up and bought the wrong thing. Double checked the ebay ad last night. It was posted wrapped in black polythene so I didn't even check the piccy on the box, you will appreciate how easy it could be to mix them up, back up on that will you? smile

Totally gutted as the same one is back up to £309 at B&Q now....arrgh!

Talk about cutting off your nose to spite your face!

Fortunately we managed to clean up the old tap and I re-fitted it using all new brass nuts/plastic washers etc so it solid now.

Buy it from Screwfix - they normally stock B&Q stuff.

Buy the correct one from B&Q, take the wrong one back in the same box with the reciept - tell them its faulty/not required/incorrectly packed. Job done.
