I won an auction for an item. It wasn't all that expensive, but I paid a good price for it, and certainly wouldn't have paid more. It's something I've been wanting to have for a while, but I wouldn't get upset if I didn't receive it as long as I get my money back.

I paid via paypal. It was offered as a payment option. The seller now has emailed me and demanded I pay his paypal fees (either cheque or paypal gift) or he won't send the item. There was obviously no mention of this in the listing.

He's also said that I can have a full refund of my money and gift the entire amount via paypal to him. There are a number of backside covering reasons why I don't want to do that!

If I refuse to pay the additional sum and he doesn't send the item then I assume Ebay will side with me on the grounds he's not exactly following the user agreement he signed up for.

I have a bit of sympathy with him because ebay and paypal are both greedy, but if you think that why sell on there in the first place?

I'm very tempted to tell him that he can whistle for the extra cash and fight it out with Ebay. He'll get stung for a sale fee, more listing fees if he tries again and won't have my cash either.

What would you do? Play nicely or start a small war?

Dont send the money as a gift, you have no protection if you do. Ask him to either send the item or refund your money and you will buy elsewhere.
Don't pay any extra (unless you are happy to), if he refuses to refund your money then open a dispute through ebay/paypal and they will refund the money unless he provides proof that you have received the item.

Don't pay anything else, and definately don't gift it to him, as you will never see what you ordered and you won't be able to put a claim in.

I do hope that he is doing all the messages through Ebay, as you can pass them on to Ebay when you start a non performing seller complaint against him.

Tell him to wise the F up and play by the rules that the rest of us have to adhere to. If he's not happy with the pricem then he should have started it it higher.

You have paid, so even if he refunds, you can not be issued a non-payment strike.

Neg him, leave 1 star rating and report as a "Non-performing Seller" - http://contact.ebay.co.uk/ws/eBayISAPI.dll?Contact...

If he gets two or 3 of them, he'll not be back on ebay. If it's a first offence he'll learn not to do it again.

It's the snidy stehawks like that who spoil ebay for the rest of us.

Agreed. It's like suing people. Don't threaten to do it, just do it.

This is a scam, pure and simple. He wants the fees money sent as a gift so he doesn't have to refund it. He is even trying to get you to send the full amount as a gift, then he will be even more in pocket.

There is no item, get your refund from ebay/paypal and move on.

He got a little abusive and admitted to doing this on previous occasions.
Negative feedback and ebay dispute have been filed. All over the cost of a pint rolleyes

Sellers are not allowed to charge extra for Paypal fees - it's in the rules if you look for it.

Furthermore, the sale price is the sale price, sorted.

To be fair he probably only listed Paypal as a method of payment because it's compulsory, and hoped it wouldn't be used.

You're in the right and he is in clear breach of eBay's policy - win to you!
