I sold an item I sell on ebay and sent to the ebay post to address.

I asked the customer to confirm this address, heard no reply so sent. No problem I thought.

The item was clearly described, and had over 200 happy customers with this product.

Anyway, it turns out the address was wrong. The customer was not happy, so I managed to get the item sent to the new address by the courier.

When the customer got the product he decided he does not like it. Says its not the quality he thought.

The item is large, I have paid to ship it, ebay fees and PayPal and he wishes a full refund. I have said the item was clearly described to which he agrees but states he is entitled to a full refund due to the statutory right of cancellation within 7 days of receipt of goods.

I am not up to speed on my laws.

The way I see it is he ordered a product, didn't like it, and wants a full refund which I disagree with. You don't buy a car and return it if its not what you thought it would be like.

It may only be a few quid to most people but keen to understand legally whether I can tell him to "stuff" it or whether I should oblige and offer full refund.

Any advice welcome smile

Under distance selling he is entitled to a full refund but must return the item to you first.

once its returned to can then cancel the transaction and get your fees back but you loose the postage which you paid to send it to him.

But if he doesnt post it back recorded " it didnt arrive did it " paypal will only ask him for the return tracking number and when not supplied not issue a refund.

sounds good.

I assume he can only return it if it is recieved back to us in good condition.

He reckons it is damaged too, despite being delivered in good condition. I assume it must be in good condition for me to offer a refund.

That fleabay selling thing sounds a right bloody pain at times!

Hope you get it sorted out, OP.

Of course, I do understand that everyone is entitled to some rights under the law etc.

What's the legal position for distance selling for a non business transaction? I.E. Between private induhviduals as ebay is (or should be)?

I saw "200 positive feedback" - sorry my brain is mis-firing today.

But my question stands separate to the OP - what is the legal position?
