Can I message an ebay seller after listing has ended?

I have been in contact via ebay with a seller. The item did not sell. Can I now message the person via ebay, saying I am still interested? Will ebay stake a claim if I buy it?

Yes you can.. done it many times, and offer a lower amount

Open the ended item and "Ask a question".

eBay won't stake a claim (as you put it) if you agree to Paypal the money to the seller but for both parties' protection it would be better for him/her to relist it as a Buy It Now at the price you agree.
