A friend got married 10 months ago but has since met someone else and started an affair.

His wife found out and threw him out of the house. He went and moved in with his new woman.

His wife paid the deposit for their house when they bought it and she paid for most of the furniture and stuff like garden decking, he had no interest and had no money to pay for anything.

He has stopped paying his half of the mortgage and council tax and the bills, basically relinquished all financial responsibility for anything joint and to do with the marital home.

He says he no longer needs to pay for anything as he does not live there.
However, he did want half of any money back from the house when sold but they had it valued and it is worth less than was paid for it about 2 years ago. He then told her she could have the house but on the condition that she did not go after his pension (he will have an excellent pension and an early retirement due to the nature of his job).

He still has keys to the house and he comes back when his wife is not there to pick up things.

Comments and advice on the above much appreciated.

Sounds like someone who has a rude shock coming when they open their eyes and ears and take in the meaning of the phrases "joint and several liability" and "marital asset". Hope he enjoys himself.

I think he may have a whole different perspective on the situation when her lawyers get involved.

Exactly my comments to his wife and her parents!

So, can he just bugger off and not pay anything like he is doing?

What can be done to enforce him facing up to his responsibilities - he's had it really easy, as mentioned he has not put anything financial into purchase of the house other than possibly half the legal fees but his wife paid the entire deposit from the sale of her flat.

No Kids?

Sounds like she can support herself, I expect she'll just want a quick divorce and to see the back of him ASAP.

Is she good looking?

So. He wants to walk away from his half of the negative equity/loss, stop paying half the mortgage and in return recieve a promise she'll not sue him for a chunk of his pension (albeit it would be small, I suspect). Nice.

Poor lass. Sounds like she's well rid of him. She should get the accounting done to get a figure she should expect him to pay and then consider involving a solicitor. If he and she want a clean break that sounds sensible - but that doesn't mean he shouldn't have to stump up his share of the losses on their property.

Sorry but your mate sounds like an idiot. I hope she finds someone decent when the dust settles.

Well he was a mate, but not anymore!

I sided with my sister-in-law and rightfully so - she's done nothing wrong.

Ensure you sister in law gets a Declaration of Trust drawn up and signed by him stating that he is giving up all rights to the house etc and neither will go after each other for more money etc in years to come.

It's something her solicitor should do as a natural course of the divorce etc, but she needs to protect herself from him should he come scrounging for money at a later date (especially if the house makes a profit or she inherits money etc somewhere down the line).

Wrong.
He should get a bill for his half of the negative equity.
