Jail for passing on STD?

I "might" have Herpes. Some time ago I had the (genital) symptoms, but by the time I got to STD clinic (holiday period, closed) following also some pills from doc, symptoms had gone and tests (for all STDs) were negative. I have never sufferd any recurrence. I believe Herpes test will only be positive when one is displaying the active symptoms. Not in any relationship right now, but I wonder what should one do in this case?
Does this guy deserve jail? You know, when in relationships, people often tell lies and do rotten things which hurt their partners in many ways, usually emotional/psychological. Do we complain to the police every time our partner does something nasty? I suffered 1 year+ depression after my partner bed-hopped (while plotting it behind my back). Should I take her to court for that? (That was before the Herpes, so don't jump to that conclusion!)

As much as what he did was wrong and he should have shared this info with her a custodial sentence seems incredibly severe. If it was a one night stand and they didn't use protection I don't see how that could be enforced, but as they were in a relationship it's deemed to be worse. I always try to warn girls that I'm bad news when we get together, I see it as a disclaimer, they find it endearing for some reason. Not that I have Herpes...

You don't always know if you are carrying Herpes or not. Many people are carriers but never show the symptoms. I've had the symptoms once only, but no positive test. Ever had a cold sore? It's the same thing.

Yep, harsh but fair. Thought the article said he knew he had it and chose not to tell her? If so 'surpasses any little white lies (or "Christ I can't tell her that or I'm dead" omissions) I made in my marriage. I would never have not told a partner if I had a transmittable disease, esp. one that lasts for life. No excuse at all in my book. Mind you, it was written by Judge Dread!

Jailing for HIV (rightly) is one thing, but according to the link (honest, I know nothing about genital herpes) this is a trivial condition in comparisonI wonder how many blokes this girl will pass it on to in the future... shame she won't get 16 months for every one of them...
