Hi PH,

I recently purchased a 2012 Mercedes Benz C-Class (50k mileage) from a local dealership. The car was supplied with a fresh MOT (no advisories) and service.

I have since taken it to a specialist Mercedes garage who unfortunately found a number of problems with the car, including (among other things):

- Engine oil overfilled by 1L
- Rear subframe rusted through (hole)
- Brake pipes corroded
- Gearbox oil leak

It’s since gone back to the dealership who are shirking responsibility, claiming these things would not have been picked up on MOT and therefore they don’t need to be rectified.

I’ve attached the pictures, and as you can see, these problems at appear to be obvious (to me).

From the pictures & description, should this have been picked up on MOT and/or should I have been informed about this prior to sale?

If so, what course of action can I take if they refuse to carry out/pay for the work needed?

About 6 weeks ago now, about a month when I first raised with the dealership

I've had advisories for brake pipes before, but at least one of those looks like a fail to me.

Do you know which MOT station did the test ?

Do you know which MOT station did the test ?
He can look that up online using a code from the V5C.

Is there a time limit to make a complaint to Vosa?

From memory it's a higher time limit for corrosion issues?

Get it tested, you won't be able to drive it when it falls. Send them the failure giving them the option to repair or refund.

Don't mention reporting to dvsa at this stage. Wait for their reply. Then report if is not satisfactory. That won't help you though, in the short term.
