I have averaged over 65 hours a week for this guy, I get back tonight and he says "I'm selling your truck tonight I won't be needing you again". The guys a complete toss** furious

How long you worked for him, what area are you in, did you have any warning.

10 months no warning penrith cumbria, contract says I should get verbal warning written warning and final written and 2 weeks notice. When I pointed this out he said he would give me 2weeks basic in lieu of notice, still need to see citizens advice as I have done nothing wrong recieved no warnings and average 20 hours a week over legal limit

That seems a contradictory sentence ?

Someone will probably be along shortly to say you have few rights working for an employer under 12 months..

As I class C+E licence holder, having a cpc and operators licence It doesn't surprise me that truckers get such a bad press if you happily admit to working illegally, you took all the 'possible' risk & it didn't get you any brownie points with your boss.

I dont know how you get your pm's its the first one ive sent, i think it was to your email address.
The gist of it was a haulier in Northwich is taking on, but now youve said your in penrith its probably too far.

When you say you work 65+ hours a week......

Do mean from clocking in to clocking off?

Do you mean driving time?

Do you mean actual working time (driving + other work added together)?

Just saying 65 hours leaves it wide open to interpretation

just added my last 17 working weeks hours up and divided by 17 result was 65
these are start work finish work times and include loading driving unloading etc.
All days are legal as in three 15 hour days and two 13 hours in a week all driving times adhered to ie two 10's hour driving days and the rest 9's. it's just the 17 week average that is a bit high.
Tachos checked by Vosa this week they seemed fine to them. Think I might get a vosa application form they could obviously use my inside knowledgehehe

Constant threats "if you don't do it i'll get someone else that will", "if you want a break go and work for some f****r else". Industry standard in these times i'm afraid.I also have cpc in transport management.

He owes you 2 weeks pay, thats it. Very few rights until employed 2 years

As long as you have complied with the EU tacho rules then nothing else matters


The RTWTD is the mobile workers WTD and refers to working times
The RTWTD is NOT, I repeat NOT, enforced by any authority in the UK
There are no VOSA sanctions in their sanction list for breaching the RTWTD
No driver or company has been taken to task over the RTWTD since it started over 5 years ago

ah thats why they never had a problem with me then, not bothered about averages, thats good to know

A footnote to others reading -

The RTWTD is often enforced by blue chip companies and drivers are given COMPANY infringements for non compliance but those are NOT LEGAL infringements or TACHO infringements so do not accept them as such

Companies often have their own policies about the RTWTD so check with them about that as it is possible to get dismissed for company policy non compliance

Good luck but u cant claim unfair dismissall until employed for 2 yrs

From my limited knowledge i believe that contract is not worth the paper its written on in these circumstances as the employer will simply state that it is an economic issue

Had you been dismissed for misconduct or failing to comply with company policy then that would have been different so would replacing you without good reason

After a specific time period which is now 2 years for employees that started in April this year I think but 1 year for those employed before that then you have certain other rights such as using an employment tribunal

As I said - I have limited legal knowledge on this but I'll bet I am not that far off course

Ok, probably a dumb question here - is he actually sacking you? By the description in your first post it sounds more like he's is making you redundant than sacking you.
