I hit this:

And it did this:

As you can see, the hole is well within the white line.

Do I have a case for compensation? New alloy wheel was £120!

Any advice? Anybody have experience getting compensation from BEAR Scotland?

Cheers Guys

I don't know about compensation, but it looks like that was a bit of a scary encounter.
I'm glad you're O.K.

Yeah, it was quite a bump!

Three other cars had pulled over just after, all with wheels like mine!

Yes you can but you need to put a claim in without delay. Sister did something similar a few months ago but the council said it had to be filed within 14 days blah blah blah. Not sure what their time limit meant seeing as you can easily issue a summons anyway.

I had a claim a couple of years ago - genuinely hit a pothole and it distorted a rear tyre.

Council "didnt know hole was there so were not liable". Apparently they only pay out if the hole was there and they had been informed but they had not done anything about it within 24hrs. They also referred to some sort of log they have of the road being pothole free. I am sure it is possible, but good luck.

Robbie,

This happened to me some years ago with a Corrado. Exact;y the same sort of hole just outside Braco, completely unmarked. Result two square wheels. I wrote to Perth & Kinross County Council Roads Department immediately, and they paid for two new wheels with no argument. Things will no doubt have changed for the worse since then, but with your photographic evidence I would go for compensation as hard as you can.

Good Luck (and Happy New Year)!

Ian.

Pictures with measurements to the responsible authourity.

They should pay up as they have already repaired that section previously and know that it is a problem area. Regular checks should be made to check the road is in adequate condition.

That hole is very deep and way past any sort of "it just happened we didn't no about it" excuse IMHO.

Cheers for the info guys!

I'll chase them up then, write to the chief executive of BEAR. A good point made above that it's a place which has previously been repaired, so it's a hole they knew about. There's no excuse.

Hi

I had an incident just under 2 years ago where I hit an enormous hole that was in a lane (single car width and one way) which bent two wheels and ripped my front tyre open (only going slowly but hole was extremely deep). The AA patrol had just attended another person who had done the same thing 5 minutes before me.

I got in touch with this lady who had a similar incident and she said she lived nearby and had heard of 3 others who had done the same thing including her BF. I contacted the council who repaired the road virtually immediately and I took photos of the new repairs and contacted my insurer who said they would cliam off the local council.

Approx 2 months passed and the insurer wrote back to me with a copy of the response from the council which said that they did not accept any liability for the condition of the road as they had inspected it 10 months before and it was OK and furthermore they did not entertain any insurance claims made against them.

The repairs had been done, the cost was approc £900 and I had to pay £350 xs and it has cost me an extra £100 roughly on each of my 2 insurance policies for 3 years and about £75 extra on my wifes policy, so total cost to me has been approx £1175.

So, I now wish I hadn't bothered claiming!

thats why you slap a county court summons in and let a magistrate decide. the council may have rules - but so do the courts.

This is the West coast of Scotland; no Scamerati here!! Those were other folk who had hit the same hole!
