Several months ago I bought a car which was stolen about a week after I bought it. It was recovered a couple of weeks later, but it has taken 3 months to fix some fairly minor damage (spoiler and some plastic bits from the induction system missing).

I finally got the car back, and in the meantime it's MOT has expired. I took it straight in for an MOT and it failed on damage to the front suspension - namely
"OFFSIDE AND NEARSIDE FRONT LOWER ARM INNER BUSHES DISPLACED"
The MOT tester said this could well be the result of abuse while stolen.

The insurance company are claiming it is a wear and tear item.

I'm thinking of making a complaint along the lines of
a) the length of time it has taken to fix the car
b) that the car was returned to me in state that according to the MOT is "dangerous to drive". If they've inspected it, even if they don't think they're liable for the suspension damage they should have notified me that it needed attention.

Any opinions would be welcomed.

Surely the reparing garage has failed its job in reparing the car, this should have been dealt with at the same time

The garage only did the repairs that the engineer asked them to do, and even then they subcontracted it out to a different garage!

It's the engineer that seems to be chief numpty!
The garage have just dragged their feet.
