105-year-old car gets congestion charge penalty notice
A museum's 105-year-old Daimler which hasn't been on the road since 1947 has had a penalty notice for evading London's congestion charge.
The veteran car was said to have been driven into the capital at 8.15 on the morning of February 17 without paying the £5 charge.
The notice said the car had been seen at Elephant and Castle/London Road. "The contravention is supported by a number of evidential images."
The car, with the number plate Y99, has a maximum speed of only 15mph.
"We were surprised to get the paperwork because the Daimler has not moved under its own power for decades," said Andrew King, curator of the Bristol Industrial Museum, where the car has been on display for 25 years.
The administration centre for the London congestion charge penalty notices is in Coventry where the Daimler was built in 1898, says The Daily Telegraph.
Transport for London said: "It would be ridiculous to expect there are not going to be individual errors."

A quick look around a motor museum should get a few ideas, or Herbie, Noddys car, Brum, or Postman Pats van, the possibilities are endless and quite ammusing just print out some 'plates' and stick them to your motor

Hmmmmmmm raceboy...thats an interesting challenge indeed.
Rather than getting a car number plate, id be a bugger an use the one off of a scooter or something like that.
Then when the cameras check the plate, itll come up as exempt......

Quick query, a colleague's girlfriend has just received a request (well demand with menaces really) saying she went in last Thursday and didn't pay the charge.
Only issue is she lives in Reading and never drives into London, therefore it cannot be her. Unfortunately she is not working at the moment and was decorating all day. So not even any shop receipts etc to show she was somewhere else at the time.
The enclosed info tells her all about how to pay, but obviously nothing about how to appeal. I've had a quick browse on the web and cannot find any guidance as to how she should appeals against this charge.
The letter she has received also states TfL have "substantial evidence". Does anyone know if a picture of the whole car has been taken and if you can identify the driver from this, or is it just the numberplate?
Advice greatly appreciated.

how come 'guilty til proven innocent' has mysteriously been found to be irrelevant in the case of the motorist. I had the same problem, I had a letter from some borough council in London saying I had been caught in a bus lane. Luckily I was at a funeral that day in Hertfordshire and had plenty of witnesses to prove it. Take a photo of your car showing the plate, send it in and tell them you have witnesses to prove you were not in London. You must have overlooked the visit from one or two friends that day.
From reading elsewhere I understand you have to pay for the photo, which does seem unfair. There have been a few articles about the Data Protection Act and the Congestion Charge.
I seem to recall that you have to pay for the photo, then when found innocent ask for the photo charge to be refunded. However it does depend how much the photo shows of the car.
Seems to me that if I wanted to avoid the charge I would look around until I found a car the same model and colour as mine. However unless the photo shows the driver it doesn't prove you were driving or not.

CVP - I've just checked the Congestion Charging website, and if there is any info on there about how to appeal, it's very well hidden. There is an email address that you could try though: enquiries@cclondon.com.

Somehow I can see their appeals process being swamped, and Derek Turner of TfL, who said they'd pursue all non-payers mercilessly, having to eat his arrogant words.

I think Dick Dasterdly's car (often seen at Goodwood) would be good.
If buses are exempt maybe a trip to the Bus museum could be in order, we could all drive them into central London (using the M4 bus lane), I mean who would notice a few more empty buses on the roads of London.
AFAIK anybody who is claimng you are "guilty", has by law to provide the evidence, and this at NO CHARGE!! I'd think that anyone who is wrongly charged by the scumbag socialist Kengestion Charge should wait and play it along until it gets to court and then and only then refute it, as the LCC is in no way exempt from the law. The more who do this, will help to get this highway robbery stopped as you'll clog the system right up!
AND THEN bring charges against RedKen for harassment, loss of earnings, libel, false accusations, wrongful arrest, etc...... which you are legally entitled to do! EU law and all that!!! Innocent until proven (in a court of law and NOWHERE ELSE) guilty!

Correct. The 1996 Criminal Procedure and Investigations Act rules that any party who wishes to rely on evidence at a Court hearing must disclose the content of that evidence, whether written statement, photographic evidence or other, to their opponent.

Seems to me that a good ruse is simply to copy the plates of a car that is the same make, model and colour as yours and then drive that one in. Then if you don't get a picture of the driver, but simply the plate and a bit of the car you will potentially be home free.

I don't believe she'll be scuppered at all. To the best of my knowledge TfL cannot invoke Section 172 of the RTA to force this lady to confess who was driving. As previously stated, the onus should be on the prosecution to prove their case - otherwise they could be falling foul of the ECHR. A video print of registration plate hardly constitutes compelling evidence. After all, it is the driver - not the car -they are prosecuting.
This misreading of registration numbers could rapidly escalate into a complete shambles.

Oh I hope so. We do need to do something about London congestion, but I don't think this was the best idea. Hopefully if this one falls on its arse it should stop this type of thing for a while.
Unfortunately it's a bit of a chcken and egg situation to get people onto public transport. I guess we can thank underinvestment in public transport by many governments of all political flavours for the situation we are in now.
Short term views by the lot of them. Nothing built to last and no really long term strategies for the benfit of the country, just projects for their own short term gains. If it was performance review time I can't think of a single politician who would get a decent review.
