hi all

ive put a deposit down on a car that was at another dealership after being verbally told that if the car wasnt right i could have my deposit back.

a week passed and i got a call saying the car had arrived. when i went to see it, it was a disgrace, mainly cosmetic but a 2 year old car looked 10 year old. i was told it would go to the bodyshop to be sorted. i was told that all tyres would be replaced if under 3mm (they were, one was illegal). there was also a small hole in one of the seats that would be repaired.

another week passed and i turned up to inspect the car for a second time and agree finance, but the car was still not satisfactory. ie no tyres changed and seat not repaired. the car had been valeted as some of the lighter scratches had been buffed out, but in the main still not acceptable imo.

where do i stand, can i get my deposit back or do i have to give the dealer chance to put the car right for a 2nd time?

im not sure i even want to deal with the garage on principle.

many thanks

hj

Not being funny but why hand over a deposit without even seeing it first? What is it?

I don't know your legal rights here but I would never take a traders word for it over the phone regarding a guaranteed refund.

Sorry, just sounds crazy to me.

ETA: Sorry if I'm wrong about the phone bit, was just trying to picture the scene.

They probably asked for it due to cost/hassle of tranferring the car between sites inorder to ensure op was serious.

If had been over the phone no issues wink- distance selling regulations means money back with 7 days no matter why you no longer want iirc

the only way I could get him to bring the car in was buy paying the deposit.

Like I say, I was told I could have back.

And whilst wondering round the shop I heard at least 2 other salesmen use the same tactic.

Anyway were past that point now.

Not sure why you're asking the question here if you haven't asked for the deposit back. Be firm with them. They have messed you about. Assertive not aggressive should get the deposit back.

it wasn't over the phone and it's been 2 weeks (beacuse of their lack of speed)

Tell them straight, your not happy with the car/repairs and you are giving them x days and one last chance to sort it agreed standards, if it is not done then leave it and demand the deposit back.
Stick it to the man!

FYI: i wanted a cool, meaningful image. But this will do.

I'd go down there at the time he says he's going to ring...sounds like he'll be there then.

not sure what time he is ringing.

but if he's difficult, i'll ask if he wants to have the conversation on his sales floor in front of prospective customers.

Do the adverts of the dealer in question feature a picture of a kind old man, with a smile as gentle as silence?

That's fair enough. It should've been a walk in the park!
Better luck next time. wink
