Hello all..

A question about selling cars from a layby...

I live (unfortunatly and not for much longer) on a main road into a small town.

The only parking is in a layby that runs for the length of the houses - but used by residents of both sides of the road (so usually totally full).

Now, for some time (on and off over many years) someone has been selling cars from one end of this layby - usually 3 or 4 cars there at any one time (most of which are soo badly repaired they look multi coloured and some of which would rival anything in the PH Horrers thread).

This winds me up for 2 reasons.

1. The cars are obviously hooky / cheap bodge repair Cat D and I actually feel sorry for the poor suckers that buy them... The guy must be operating without declaring that he is in the trade?? No way are these cars legit.

2. The layby is short on spaces anyway - could do without him filling it up with abominations.

Is there any law concerning this? If he is registered as a motor trade business is there anything to be said about using a public layby to display the cars?

Cheers,

Adam.

Inform your local Council (Trading Standards). They will be removed.

Lowestoft and surrounding areas were plagued by roadside cars. Left on a main road without insurance and some did not have tax.
Also I think the sellers were also hounded for not having a traders licence.

Annoyingly they love to leave them in residential areas as of course it looks more legit by giving the impression of being sold by a local home owner - A classic trick is to move the cars up-market to the slightly better side of town.

1/ Report the cars to the authorites as fly tipping, "the cars appear to be abandoned officer". wink

2/ Call you're local driveway clearance specialists to hi-ab' the cars to the nearest scrappy where they belong.

3/ Make a sign that says "residents of ****** street parking only. Other vehicles will be clamped!". wink

Thanks for the advice people!

I don't know if I can have them removed as "abandoned" as they are all taxed etc (and probably "legal" if only just).

I'll give the council a bell and see what they say... at last I might get some VFM from my council tax!! smile

Re the thread title... it did have one when I posted it (from an iPhone)... but disappeared when I sumbitted... so a site coding issue rather than my own fault.

I'm pretty sure there's a rule that you're only allowed to advertise up to 3 cars for sale on the same stretch of road, otherwise you're classed as a trade dealer... i could be wrong, but my mate had problems with this when he was going to Australia, having to offload all the cars with difficulty... ended up keeping 1 of them garaged at his parents until he got back!

In no way would I advocate this, and it is completely illegal and certainly not what happened to a family member of mine;

Go and find a "residents parking only" sign, nick it for 2 days, put it up where matey-boy parks, he'll realise he can no longer park there and so move, then go and replace the sign. Never seen or heard of them since. Allegedly.

If they're taxed and insured then they can park on any (non yellow lined) street they like...

And if they are a resident of that area too, it'll do no good at all....

Anyone stupid enough to buy a car from a layby deserve all they get IMO. It's stupid people who are the reason this practice exists. Dubious cars that have come from an auction that they were put through because they were dogs in most cases.

I think you need to read the OP.

They are not meaning this:

but this:

Which is altogether rather different.

Interestingly, I had my car parked up in a parking bay (that had no restrictions to park in it) a few years ago when I was selling my car. The bay being just outside my house at the time.

I had a sign up in the window, you know the usual thing that people do. Car was there for about a week before I got a call from the local comunity support officer who said she was by my car and wanted me to come down for a chat with her. I'd love to tell you the reason she gave me at the time as I'm sure it would help you out but essentially, she read me the riot act about me being not allowed to do it and insisted I had it removed.

Perhaps someone can shed some light on this for you as there may be a geniune law/rule against this sort of activity that you might be able to use to your advantage.

I may of course have been duped but I doubt it given she was a copper?
