Please mods don't delete this thread as I know that there are 2 sides to every story but I'm just asking some questions here and not slagging them off.

I bought a set of Recaro Pole Positions from them a couple of weeks ago. Due to some errors on the dimensions I've discovered that they won't fit in my car. I don't blame them for this as it's my fault.

I want to return the seats to them as this is my right according to the distant selling regulations. I emailed them over 1 week ago asking for a return address. I got a reply with them telling me that they would send out a return form and after 8 days I received this return form. On this form it says 'please we aware as stated online during the order process and on the reverse of your invoice once the seat is delivered there is a 15% surcharge on cancellations/returns due to us having to hold stock and for admin costs. This is a standard charge in our market.' They want me to sign this form and return it to them before the seats will be collected!!

This 15% works out at approx £150 for my order. I looked on their website and have gone through their order process again and this 15% charge is never mentioned, there isn't even a box to tick in order to accept their terms and conditions.

Has anyone any experience with these people or advice on the matter?

thanks

Surely someone has experience of similar terms and conditions etc?

I believe restocking charges are illegal:

Was this in any way a custom order? If so they don't have to give you anything - only if they were "off the shelf" items.

however, you're being a bit st to them to not offer something for their time/costs - after all you made the fk up

Thanks for the reply.

No custom order at all as they arrived the day after ordering. They blamed the delay on me receiving the return form on the royal mail which is absolute rubbish.

There is no mention at all of this 15% during the checkout process as they say there is.

Business sellers in 99.9% of sales cover the cost of handling/paperwork etc and this cost will obviously be included in the original selling price of all goods to cover for such eventualities.

I don't like having to return anything so if I had missed the mention of the 15% or had ticked the terms and conditions box without reading them I would hold my hands up. £150 for sticking a couple of seats back into a warehouse somewhere and providing a very simple refund is pure extortion.

If they're brand new I'm sure someone would buy them for £50 below list price. That way you save £100, don't hassle the seller and someone else get some Pole Positions at a knock-down price.
