what are my options (dealer bought car, gearbox issue)
Discussion
Afternoon everyone.
I recently bought my latest car from a dealer a week ago, its developed a clunk when going into drive.
It came with an 'rac gold' warranty, but I would like to know what my options are (save getting the gearbox fixed at my expense) as I suspect the rac warranty to be of little worth).

Read this. You are covered by the Sale of Goods Act.Don't take any crap from the dealer. Forget texting him, ring him. If he doesn't play ball, write to him and post it Recorded Delivery. You need to return the car to him with the keys so that he can repair it. Don't invoke the warranty, you have no need to.
Good luck. Keep us posted.
The warranty is an "add on", it does not mean the dealer can forget his obligations under the Sale of Goods Act (etc)

A clunking gearbox sounds concerning and I would suspect a new autobox is on the horizon. If it was me, I'd reject the car and demand a refund, given you've only had it a week. Also, write to him, not text, so there is a record.
What car is it? The Saab?

If he's a decent guy you should be OK.
The fact that 2nd hand car dealer and decent guy are diametrically opposed be prepared for a fight with a bunch of toothless tossers for company (SOG, Consumer Direct, Trading Standards, Small Claims procedure) at the end of which you will probably get a judgement in your favour which will then be impossible to enforce without further recourse to the courts etc, etc, etc......I'm sure you get the picture.

What Denis said. I spent 6 months of my life with a messer of a car dealer. If he had a car lot I was tempted to drive it into the middle of his stock and set light to it. Best of luck.
