I purchased a car privately about a month ago and the car had private plates on at the time. The seller was in the process of transferring the plates to another car at the time of the sale and as such didn't have the original v5 as it had been sent off to be changed. So I decided to go ahead with the purchase as I had a copy of the original v5 with private plate, and letter from DVLA stating that the updated v5 is on it's way to the owner. The tax and MoT had also been transferred to the original number plate. I also had the seller make a receipt for the sale stating that they had sold the car to me etc.
The problem I'm facing is that the tax is due next month and I still don't have the v5. I have contacted the seller and he says he hasn't received anything yet and would chase, but it seems he hasn't chased or he hasn't passed any updates on to me.
Does anyone have any advice??

Do you know the registration number and do you have a current MOT and insurance?
Contact DVLA yourself, its not the sellers problem now, either by phone on internet and explain the situation.
I had a similar problem some time ago and the new owner's slip from the V5C had been marked by DVLC and I could not use it at the Post Office. DVLC sorted it though once I had spoken to them.

Get form V62 from the Post Office or download it from here and fill it in. In section 3 tick the box next to "I bought the vehicle from the previous keeper or motor trader and I have not received a V5C yet". Send it off to the DVLA and wait for your shiny new V5C to turn up.
I think you may also need to pay the DVLA £25 for the privilege as well but the instructions on the V62 tell you in what circumstances a fee is payable.

It does have current MOT and insurance.

Could be worth going down to your local DVLA office with all the paper work you have and explaining you predicament. If they see you have the right documents they should be able to sort out your road tax there and then.
Excuse my ignorance but where do I find out my local DVLA office? I always thought they only had one in Swansea.
