Who's right and who's wrong?

Looking at this from a legal angle / driving style / driving fun side of things.

Two cars driving on a twisty single carriageway NSL, the first doing 40mph, the latter being held up, with no safe opportunity to pass.

Both cars enter a 30mph limit, car 1 continues at 40mph, car 2 slows to 30(ish).

A mile or so further on and the road becomes single carriageway NSL again. Car 2 accelerates to 60(ish) and quickly catches Car 1 still doing 40.

The legal aspect seems fairly clear cut, yet sort of contradicts the Speed Awareness course's idea of "Eco-Driving".

I've got my own views on this and they're unlikely to change. It's just the first time in long time that I've been for a run in the car as opposed to the bike and Car 1 seemed to be the appropriate style of driving nowadays.

Not appropriate but quite common - the 40mph-everywhere-brigade - some of the worst drivers on the road IMO in terms of observation, anticipation and general awareness. I suspect the Speed Awareness course "eco-driving" is all with the caveat of "within the local speed limit".

Ahh. Mr. 40mph... Seems to be the norm these days, or at least they do on my journey to and from work which is a mixture of 30,40,50 and NSL. drives me mad! once you get to a NSL and have the opportunity to pass they either, a. Swerve into the middle of the road just as you indicate. b. Flash lights and wave hands like mad when you do pass.
