I wondered if you was in a accident where it was the other parties fault and my vehicle needed to be repaired as was damaged slightly, do i HAVE to get it repaired after getting a quote?(ie.. before i get paid out) or can i leave it and get paid out for the repair from the quote i recieved once the dispute has all been resolved? So all i do is submit the QUOTE to the solicitor?

The reason i ask is because my excess on my insurance is £1500 (yes i know i know) and the repair is £1700. So i have to shed £1500 straight up. Could i just wait for the payment to to come through after i win the dispute and then repair it? Ive looked into it and i really cant see why they wouldnt pay me out and why i have to repair it instantly after all it is my car and it is only a scuff and a small dent. im fairly happy to drive around like it till im proven i was in the right and get paid out.

No, you can wait until blame is sorted on the basis your excess is crazy and it wasn't your fault....

I'd suggest that rather than using your insurers to repair the damage, you have three primary options:

  • You can wait and take the cash
  • Get it repaired via the other persons insurance
  • Get it repaired via a claims handling service
