Seller seems oblivious that his car's a Cat D?

A few months ago an NA MX5 with alot of nice mods turned up close to my house (Had bucket seats, LSD, front lip, lowered etc). I was interested in the car, was arranging to see it then I Hpi'd it, it came up with some interest registered against the plate. I didn't really know what the issue was, but was skeptical..
I ended up running out of time and having to head over to Liverpool. Since I've been looking for a similar car and I just saw that his is up for sale again, at £3000 now instead of £2700.
I decided to Hpi it again (this time with HPi and not the AA), again same result. I gave hpi a call and they were unsure, told me to get the VIN number/Serial from the V5 and they would start an investigation..
The seller was more than happy to give me the vin number etc, the last time I asked him about the Hpi he said it's the first he had heard of it..
Anyway, I got an email from Hpi to say that the car was declared as a Cat D write-off.
I haven't spoke to the seller yet, but he seems surprised by it all.. What do you reckon, is it new to him.. Or is he simply chancing his arm?
He would post quite a bit of a NI car forum, and has quite a good reputation over there..

If its gone up in price since it was last on the market, I reckon his last sale fell through at Data Check stage, he realised he'd bought a lemon and thought right! Ill advertise as a clean car 3k, when the buyer says its a CatD, Ill look supprised, offer 300 notes off and the bloke will go away happy.

tweasel?Personally, the key issue would be when it was written off. If it was a 20 year old Mk1 that had been written off last year, I wouldn't care - a slashed hood would probably be enough to write it off. If it was a Mk2.5 that had been written off when it was a year old, I'd want more details about the damage and the repair.
As for the seller's attitude, I guess they're hoping a buyer comes along who doesn't do an HPI. In which case, it's the buyer's fault if they unwittingly buy a cat d.
As an aside, did you really do a full HPI check on a car you already suspected to be a write off? You can do it for £3 if you use one of those SMS services.
