Someone drove into the back of me today...
Discussion
Stationary in a right hand filter lane, waiting for a gap in traffic, and someone rear ends me.
My insurance company reckon it's clear cut no-fault on my part and this means I have access to their specialist legal services provided by Albany Assistance. Googling them isn't too encouraging and I haven't committed to anything as yet.
As I see it I've got 2 definite options and 1 probable.
1. Allow Admiral to sub-contract to Albany
2. Turn down the Albany offer and request Admiral sort it out (I'll need to pay my excess under this option but it should be recoverable from 3rd party)
3. The possible one...the 3rd party's insurer may well call me and offer to sort it all out (they are apparently likely to be wary of the car hire costs as charged by Albany).
So...what's the consensus on best option? Any other options that I've not covered?
Many thanks.

My uncle has just been through this. Please please use a recommended third party revovery agent, annies dad on here is highly recommended. Google a search. Your own insurance won't give a toss, and their own 3rd party company will be in it for kickbacks. Use someone independent and who will fight for you, assume the worst and the other party will say you reversed into them!
Aren't 2 & 3 virtually the same?
Having experienced this, I'd throw at my insurers and tell them to sort it
An assistance company will give you a hire car whilst yours is fixed and try to talk up any injuries you may (or may not) have, but it's for this reason premiums are going up....
And be prepared to receive many calls in the next 10 days, offering further assistance...

Ta for the response...won't my insurance company block me trying to use a different recovery agent?Bowler said:

No...should have said, Admiral are my insurer. The 3rd party's insurer is Aviva.Having experienced this, I'd throw at my insurers and tell them to sort it

Albany is Admiral/ Elephants legal arm.
I got driven into when stationary and they dealt with my claim, they were very good. They also don't go mad trying to overinflate the claim like some of these 3rd party companies insisting you have like for like cars at £100 a day. I got hit in my VX220 and they gave me a perfectly acceptable Alfa 159jtdm, they kept me well informed etc couldn't fault them. I chose where to have my car fixed etc etc
If you make Admiral themselves deal with it you just increase the paperwork as they will treat you as your making a claim.

Must be something in the water today. The same thing happened to me this afternoon whilst waiting at a zebra crossing in Leeds. Felt a big bump and there was a Kia in the boot and a man standing on the pavement saying "b
ks". Spent 30 mins on the phone to Admiral this evening, I was also referred to Albany who are going to ring me tomorrow to arrange collection and repair of my car and the delivery of a "like for like" replacement. So far the whole thing has been hassle and pain free. I just hope the motor can be put right properly and quickly.

My car was still driveable so didnt bother with the free car..
Claim seems to be moving along ok.. Offer from the third party to settle out of court was a joke.. and was made even before my whiplash injuries were assessed..
I had some other companies phone me to offer their legal services, and i don't even know how they managed to even get my number.

Do not take the hire car from Albany!
They will overcharge massively and the other insurer will dispute the hire car fee and it will cause no end of hassle and paperwork for you to sift through to try and work out if you could be liable for their £1000+ hire car bill.
Either wait for the third party to contact you, or contact Europa Consultants as recommended on here.

I'd just ring the other person's insurer and say "Your insured broke my car. Please fix it.", and if you need another car while it's being fixed, ask them to sort you out a hire car too.
This has generally worked pretty well for me.
literally tried that once, insurer tried to dispute and ended up paying 3 months car plus repair costs. they really don't help themselves. This has generally worked pretty well for me.

Yeah, my insurers said the same when I was knocked off my bike whilst stationary at a pedestrian crossing. In March. I'm still waiting for my NCD and excess to be returned. The other guy denies liability and even though the insurers themselves say as yours have, they won't cough up. You couldn't get a much clearer-cut case than this but as long as tosspot digs his heels in, I'm out of pocket.Hope your attacker doesn't try the same tactics.
Hi
Third party agents like "Angel Assistace and Helphire" are a nightmare. Someone rear ended me. Offered a hire car. I stupidly said yes. Now I have to go to court (yes me) in order to sue the other side to get the cost of the car hire back as they are not admitting fault.
Do not bother. Its all part of the scummy insurance market/scam.

Thanks for all the replies.
On the basis that:
1. I have a witness who is 100% certain it's not my fault
2. I don't want a hire car
Is the best solution still, say, an agent like Europa, or should I claim through my insurer, or...should I get the 3rd party's insurer to cover it? Surely the latter would be the best as there would be no need to cough up my excess albeit temporarily?

I was hit in my Volvo V50, Albany handled it for Admiral, they gave me an X-Type estate for a week, when I saw the bill it was £4,000. They make their money from inflated rental charged to the other party. I got driven into when stationary and they dealt with my claim, they were very good. If i was you i'd ring the other insurer and give them an opportunity to fix your car directly. If their driver disputes then go to an agent. I've never used them but yet to hear a bad word about Europa/Anniesdad, so i'd prob try them. On the basis that:
