Going to work yesterday morning was doing a 3 point turn in a residential road visibility was clear but i had completed 2 stages of a 3 point turn so the car was horizontally positioned, wall and a raised kerb behind me. Hyundai Getz came flying down the road and tried to squeeze through the gap with very little braking between the front of my car and the kerb.......failed took off the front end. hes saying its my fault for doing a turn in the road and that he assumed that i was reversing into a driveway although there was nothing impairing his vision of where my car was in the road (plus its orange) surely hes at fault? its broad street in bromsgrove for anybody that knows it, just a residential road, no markings other than a single yellow line which states no parking between 9 and 1800 frown been on the direct gov site to look at the online version of the highway code to try and find a bit on 3 point turns but cant find anything as you cant search, any help greatly appreciated!

Sounds like it was his fault so push that with your insurance. Write down exactly what happened and stick to it. They'll probably seek to settle and you should make it clear that you find this unacceptable due to the implications on your motoring costs moving forward.

Though, in the end, they'll probably settle anyway. Robbers that they are.

Surely this is 'due care and attention' i.e. he wasn't driving with any. If a car is clearly performing a manoeuvre you aren't supposed to proceed until the car has completed that manoeuvre; he's just driven at you with no due care or attention for where you may be about to go.

Sounds like his fault to me, esp as you were stationary at the time.

thanks for the replies guys i spoke to my old driving instructor (doesnt stand for much but he said he thinks the blame would lie wtih him) im just trying to find a sectino of the highway code which i can quote with regards to 3pt turns frown

Sounds like his fault to me. Doesn't matter what manoeuvre he thought you were doing, any sane driver would've held back till you'd finished it.

Make sure you emphasis that the Hyundai driver was unable to make the correct judgement call on the width of his car and the available width for passing, also he did not allow you time to complete your actions to place your vehicle in a position to allow him adequate room to pass. Remember that a 3 point turn is one of the essentials in the driving test.

I'd state in your claim that you were stationary at the time of impact. That way you couldn't have hit him.

A dopey colleague came flying around a corner and hit a car head-on that was passing a stopped bus. The other car stopped before colleague hit them and it went down as 100% his fault.

He thought it was their fault for being on the wrong side of the road but was told if the other car is stopped then it's always the fault of the moving vehicle.

The othe driver will state that the OP moved forwards into his path. It'll go 50/50, which won't benefit either of them, but that sort of person doesn't seem to think like that and just wants to try and argue.

He says he assumed you were reversing into a driveway. Now we know that is total rubbish and clearly shows that he was trying to squeeze through a gap that wasn't big enough. Even if you were reversing onto a drive he should still have waited until he could get through.

I would say he's at fault here.
I was taught to give PLENTY of room when I see someone in the middle of a manoeuvre.

Make sure you emphasise that you were stationary at the time of the accident, and that he was driving like a bit of a twunt wink

His fault, 100%. He failed to avoid a stationary object in the middle of the road.
